WHEREAS, the Ciiy Planning Cor~mission did huld a public hearing at the Civic Center in the City of Anaheim on November 24, 1997, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipa) Code, Chapter 18.03, to hear and consider evidence for and aga~nst said proposed variance and to invesiigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, in•iestigation and study made by itself and in its behalf, and after due consideration ofi all evidenc~ and reports offered at said heari:ig, does find and determine the folloti•~ing facts: 1. That the petitioner requests waiver of the following to consttuet additional parking spaces for an existing 84,458 sq. ft., 4 story office building: (a) Seciions 18.04.060.050 - Minimum Darkinq lot landsca in . 18.06.030.040 (48 sa ft I~ndscaped Ulanter required. and 18.41.066.020 For every 10 parking spaces; ~~ne proposed for Parcel 4). (b) Sections 18.41.063.030 - Minimum landscaped setbacks adiacent and 18.41.063.040 to interior aroaertv lines. 10 feet required; 2 feet proposed for Parcel ~ll 2. That the floor area of the existing 84,458 sq. ft., 4 story office building wa5 incorcectly adverlised as 20,599 sq. ft. per tloor; but lhat said public notification does not impacl the waivers which pertain to parking lot landscaping; 3. That the proposed parking layout, including the additional parking spaces, is necessary for the office buiidin5's new t$nant to provide adequate parking for !he anticipated number of employees; CR3122PL.WP -1- PC97-170 ~ ~ 4, That strict application of the Zoni~~g Code deprives this property of privileges enjoyed by other pruperiies in the "CO" Commercial, Office and Professional Zon2, which have bee:~ granted waivers based on the provision of overall increased lar•,dscaping on the site because the proposal adequateiy mitigates the loss of landscaping by maintaining a buffer along the north property line in 1he form of tree welis every, five parking spaces; and that the dipm~ond-shaped planters in the interior of the parking lot will be an improvement over the existing fandsca in 5. That there are special circumstances applicable io subject p~operty consistinfl of its localion and surroundings, which do not apply to other identically zoned properties in the vicinity because the parking area affected by this variance is completely screened from view of the nezrby public rights- of-viay; and 6. That no one indicated their presence at said public hearing in opposition; and that no corce~pondence was received in opposition to subject petition. CALIFORNIA ~NVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal for waiver of minimum parking lot landscaping and minimum landscaped setbacks adjacent to interior property iines to construct additional parking spaces for an existing 84,458 sq. Y~., 4 story office building on a 6 acre parcel located noRh and east of the northeast corner of Orangewood Avenue and Santa Cruz Street, and having frontages of 60 feei on the noAh side of Oranflewood A~en~e and 70 feet on the east side of 8anta Cruz Street (2060 South Santa Cruz Street); and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment ryf the lead agency and that it has considered ihe Negative Declaration togethe~ with any comments rece~ued during the public review process and furlher finding on the basis of the initial siudy and any comments received that there is no substantial evidence that 1he project will have a significant effect on ihe environment. NOW, THER~~~RE, BE IT RESOLVED that the Anzheim Cily Plarvning Gommission does hereby grant s~bject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subje~t property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That clinfling vines, on maxirewm three (3) foot centers, shall be planted, ircigated and maintained adjacent to the block wall cn the norlh property line. This information shall be specifically shown on plans submitted for building permits. 2. That the following landscaping information shall be specifically shown on plans submitted for building permits: (a) That all new diamond-shaped planters shat: include trees of a size not less than fifteen (15) gallons at the time of planting; (b) That. minimum twenty (24) inch box trees shall be planted in lhe half-diamond-shaped plante~s along the norlh propeRy line; and (c) That groundcover shall be planted and maintair~ed where trees or_shrubbery are not sutficient to cover exposed soil. 3. That all required landscaped areas shall be provided and maintained with automatic irrigation systems. q, That the parking lot shall be equipped with lighting of sufiicient power to 'slluminate and make easiiy discernible the appearance and conduct of all persons on or about the parking lot. Said ligh4ing sl~ail be directed, positioned and shielded in such a manner so as not to unreasonabiy i8uminate adjacent oroperties. PC97-17U ~ ~ 5. That plans shail be submittad to the City Traffic and Transportation Manager for review and approval showing conforrnance with the current version of Engineering Standard Pian Nos. 436 and 602 pertaining tfl ~arking ~tandards and driveway locations. Subject prope~ty shall thereupon be d~~felooed_ a.nd ma~ntained in conformance with said plans. 6. That trash storage arzas shall be provided and maintained in location(s) acceptable to the Pubiic Works DepaRmeC:l, ~freets and Sanitation Division, and in accorclance with approved plans on file v.~ith said Deparlment. Such infonnation shall be specificalty shown on the plans submitted to the Pub~ic W~rl;s ~eRartment. %. That ihe trash storage area shall be developed and located in such a manner as to assure proper accessib~sih~ ia the power transformer. Plans shali be submitted to the Utilities Department, Electrical ~ngineering Division, tor review and approvai. 8. ThaS ~o ~'ec~~ired parking area shall be fenced ar otherwise enclosed for outdoor storage uses. 9. Tha't no :~dditional compact-sized parking spaces shall be permitted. 10. That an on-site trash truck tum-around area shall ~e shown on plans submitted for building permits and that said tum-around shall comply with Engineering Standard D~tail No. 610 as ~equired by !he Streets and Sanitation Division of the Public Works Department. 11. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Public Works Depariment, Stree',s arod Sanitation DivisiGn, for review and approval. 12. That subject property shail be developed substantially in accordance with plans and specification submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1, and as conditioned herein. 13. That prior to issuance of a building permit or within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 1, 2, 5, 6, 7 and 10, above-mentioned, shall be compiied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.09G of the Anaheim Municip~l Code. Furlher, if an extension ot time is requested for the aicohel sales po~tion of this request, it shall ue considered at a noti~ed public hearing. 14: That prior to final zoning inspections Condition Nos. 3, 4, 11 and 12, above-mentioned, shall be complied with. 15. That approval of this application constitutes appraval of the proposed request only to the extent that it complies with the Artaheim Municipal Code and any other applicable City, State, and federal regulations. Approval does not include any action or findings as to compliance or approvai of the reGuest regarding any other applicable ordinance, r2gulation, or requirement. BE IT FURTHER RESOLVcD that the Anaheim City Planning Commission does hereby find and determi~e that adoption of this Resolulion is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set foAh. Should any such condition, or any part thereof, be declared invatid or unenforceable by the rinal judgment of any court of competent jurisdiclion, then this Resolution, and any appruvals herein contained, shalt be deemed null and void.
