Resolution-PC 97-183~ ~ RESOLUTION NO. PC97-183 A RESOLUTiON OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING CERTAIN CONDITIONS OF APPROVAL OF RESOLUT~ON NOS. PCONDITI NAL USE PERMIT NO 3~464 CONNECTION b111TH WHEREAS, on October 21, 1991, the Plai~ning Commission adopted Resotution No. PC91- 166 to permit a church in an existing industrial buiiding at 5100 East La Palma Avenue with waiver of minimum number of parking spaces; and that Condition No. 17 of said resolution limited the use to a period of three years; and that one extension of time was granted by ihe Plannir+g Commission on December 12, 1994, under Resolution No. PC94-164, to expire on October 21, 1997; WHEREAS, this property is de~:~;lo~.ed w;th a 3,900 sq. ft. church in two tenant spaces of an industrial complex; and that the property i~ iuc~tri; ir...[~euelopment Area 2(DA-2) of the Northeast Area Specific Plan (SP94-1) and is also in the Proje~'[ Alph~+ FJ~i'~;east Redevelopment Area; WHEREAS, the petitioner ha~ c~que„F~9 thst said Condition No. 17 be modified or deleled to retain the 3,900 sq. ft. church within the 138,350 sq. ft. indusirial compiex, under authority of Code Section 18.03.093; WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on December 22, 1997, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance wiih the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find an~i determine the following facts: 1. That subject use permit is being exercised substantially in the same manner and in conformance rrith all conditions and stipulations as originally approved; 2. That the use permit is being exercised in a manner not detrimental to the particuiar area and surrounding land uses, nor the public peace, heaith and safety and general welfare; and 3. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: Tnat the Anaheim City Planning Commission has reviewed thn proposal and does hereby find lhat the Ne~ative Declaration previously approved in connection with Conditional Use Permit is adequate to serve as thE required environmentai documentation in connection with this request upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the previously approved Negative Declaration together with any comments received during the public review process and further ~nding on the basis of the initial study and any comments receive~ ihat ihere is no substantial evidence that the project will have a significant effect on the environment. CR'~~44PL.DOC -1- PC97-183 ~ ~ NOW THEREFORE BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Condition No. 17 of Resolution No. PC91-166, adopted in connectian with Conditional Use Permit No. 3634 and amended by Resolution No. PC94-164, to read as follows: 17. That this conditional use pPrmit is granted fcr a period of four (4) years and shail terminate on October 31, 2001, cuncurrently with termination of the current lease agreement.
