USE PERMIT NO. 3926 ElE GRANTED, IN PART WFdEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditionai Use Porrnn 3926 for cercain real properry situated tn the Cfry of Anaheim, County of Orange, St~te of Califomia, desr.ribed as: PARCEL 3 OF PARCEL MAP NO. 80-236, AS SHOWN ON A MAP FILED IN BOOK 148, PAGE 3 OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE COUNTY, CALIFOR~IA. WHEREAS, the C'dy Planning Commission did hdd a public hearing at the Civic Center in the Gtty of Anahelm on Ap~il 28, 1997 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the prouisions of the Anr3heim Municipal Code, Chapter 18.03, to hear and conskier evfdence for and against sald proposed condftionaf use permft and to investigate and make findings and recommerxiations in connection therewith; and WHEREAS, said Commission, after due inspectfon, irtivestigation and study made by ftseif and in its behalf, arxl after due consideration of all evidence and repc~rts offered at said hearing, does ftnd and determine the fdlowing facts: 1. That the proposed use is properly one for which a condftional use permit is authorized by Anaheim Municipal Code Sections 18.03.030.010, 18.44.050.060 and 18.44.050.085 to permft a trailer sales lot and repair fac(lity with waivers of the fdlowing: (a) Sections 18.04.060 - Minimum landscapfna adjacent to res(dential zone boundaries. and 18.44.063.040 (b) Sections 18.04.060 - ~rmitted encroachmerrts into setback areas. and 1&.44.064 (c) Section 18.44.068 - p~^~~j~Pd site screenina. 2. That waivers (a), (b) and (c) are den(ed on the basis tl~at they were deleted following public no4'~ication; 3. That the proposed use (vehicle sales and repair) is properly one for which a condftional use permit is authorized by the Zoning Code b~~t that "trailers` are not spec~ically listed therein as 'vehicles"; 4. That the proposed use wiil not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be lacated; 5. That ihe size and shape of the sfte for the proposed use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safery and general welfare; CR2884PLWP -1- PC97-45 ~ ~ 6, That the traiflc generated by the proposed use will iiot impose an undue burden upon the streets and highways designed and improved to carry the tr~rfic tn the area; 7. That the granting of the conditional use permit~ under the conditions tmposed, will not be det~imental to the peace, health, safery and general welfare of the citizens of the Ciry of Anaheim; ar~d S. That the gates at the dfireways on Beach Boulevard shall remain open du~ing ousiness hours. That plans specifying how said gates will function shall be submitted to the City Traiflc and TransporYation Manager Tor review and approval. The submitted plans shall show minimu~m drive-aisle widths of twerrty four (24) feet between the rows of park~ng on the south side of the building unless otherwise approved by the City Traffic and Transportation Manager. 2. That no oucdoor display of any prorlucts or vehides other than utiliry-type trailers shall be permffied• 3. That na outcloor work on trailers or traller parts shall be permittsd• 4. That no ampl~ied sou~d system for pagin~, advertlsing, or music shall be permitted. 5. 7hat the hours of operation shall be limfted to 8 a.m. to 5 p.m., Monday through Saturday, as identfffed in the letter of operation submitted by the petitioner. 6. That the proposed freestanding sign shall be a monument-rype not exceeding elght (8) feet in haight and shall be subject to the review and approvai of the City Traffic and Transportation Manager to determine adequate Iines-of-sight. 7. That pians shall be submitted to the Ciry Traffic and Transportation Manager for review and approval showing conformance with the latest revisions of Engineering Standard Plan Nos. 436 and 602 pertaining to parktng starxiards and driveway locations. Subject properry shall thereupon be developad and maintained in conformance with said plans. 11. That trees shall not be unreasonably t~immed to increase the visibilfry of the faciiiry. 12. That the owner of subject property shall submit a letter to the Zoning Division requasting termination of Condftional U~e Permit No. 1498 (pertnitting the corrtinued use and expansion of an existing plarrt nursery with waivers of permitted driveway width, maximum building height and required block wall adjacerrt to RS-A-43,000 zoning). 13. That a plan sheet for solid w3ste storage and cdlection and a plan for recyding shall be submitted to the Public Works Department, Streets and Sanitation Division, for review and approval. 14. That an on-sfte trash truck tum-around area shali be provided and maintafned to the satisfaction of the Publ(;, Works DepaRment, Streets and Sanitation Dfvision. Said tum-around ~rea shall be specffically shown on plans submitted for building permits. 15. That the developer shall submft a water quality management plan (WQMP) speciflcally (dentifying the best managemont practices that will be used on site to co~~trd predictable poltutants from stormwater runoff. The WQMP shalt be submitted to the Public Works-Engineering ~epartment, Develepment Services Division, for review and approval. 16. That plans for a comprehensNe sign program, detailed buildfng elevations and landscaping shall be submttted to the Zoning Division for review and approva by the Planning Commission as a'Reporis and Recommendations" item. The landscaping plan(s~ shall include a three (3} foot high landscaped berm adjacent to Beach Boulevard, minimum ons (1) gallon sized v(nes planted on max(mum fivo (5) foot centers adjaceM to tha trash endosure walls, and the spectflc size, type and loaatfon of all landscaping mate~ials. 17. That sfgnage for subject facility shall be I(mited to that which is specffically shown on the exhibits submitted by the petitionec•, except as othervvi;,e conditionad herein. Any additional signage shai! be subJect to approval by the Planning Commission as a'Reports and Recommendations' ftem. 18. That a Lot Line AdJustment Plat (to modify the wast properry 11ne of this property to combine the zear sixry (60) feet of this property wfth the property to the north for parking purposes in ccnnectton with the adjaceM batt3ng cages and arcade) shall be submitted to the Subdfvision Section for review and approval by the Ciry Engineor and then recorded in the Office of the Orange County Recorder . 19. That subject properry shall be developed substarnEally in accordance w~ith plans and speciHcatbns submttted to the City of Anaheim by thA petitioner and which plans are on ftlo with the Planning Depanment marked Exhibit Nos. 1 through 6, except as otherwise condftioned herefn. 21. That prior to issuanr,c of a building permit or within a period of one (1) year from the date of this resolution, whkhever occurs first, CondRion Nos. 1, 7, 10, 12, 13, 14, 15, 16, 18 and 19, above-mentioned, shall be complied with. That prior to flnal buitding and zontng inspections, Condition Nos. 8 and 20, above-mentioned, shall be compfied with. 23. That approval of thts appl(cation constftutes approvai of the proposed request only to the exterrt that ft complies witl~ the Anaheim Municipal Zoning Code and any other appl(cable Cfty, State and Federal regulatiuns. Approval daes not include any actian or flndings as to compliance or approval af the request regarding aa~y other appifcable ordinance, regulation or requirement. 24. That traiters shall only be dlsplayed in the areas shown for display on the approved sfte plan. 25. That used trailer sales irnentory shall be Iimfted to no more than ten percent (1096) of the on-sfte trailer irnerrtory. 26. That a maximum of une hundred (100) traflers for sale shall be displayed at any one time and that a maximum of ten (10) traller5 awafting for, or that have finished being repafred, may be stored outside. 27. That, as stipulated to by the petitioner at the public hea~ing, an agreement to provkJe proper drainage from the rear of the property to the street shall be signed by subJect properry owner and the property owner immediately north of subject property. Said agreemeM shall be submitted to the Zoning DNislon for submfttal to the Public Works, Development Services Division for revtew and approval. BE {T FURTHER RESO! Shoui~+ any such condition, or any paK thereof, be declared frnalid or unenforceable by the Bnal judgmert of any coun of compet9nt jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
