A RESOLUTION OF THE ANAHEIM CITY PIANNING COMMISSION
THAT P~TITION FOR CONDI710NAL USE PERMIT N0. 3918 BE GRANTED, IN PART
WHEREAS, the Anahelm Ciry Ps~~ted inthe City of Anaheim~County of Orange, State
CondRional Use Permft for certain real property

WHEREAS, the Ciry Planning Commission did hold a publlc hearing at the CN(c Ganter
in the Cfty of Anaheim on March 17, 1997 at 1:30 p.m., notice of said public hearing having been duly
given as requireci by law and in accordance wfth the provtsions ofi ihe Anaheim Munlciaai Code, ChaPter
18.03, to hear and consider evide~ce for and against said proposed conditlonal use Pe~mit and to
wassaontinued to the Marchs3la nd May 28, 1997 Planning i mmission~meetingsaand Pu~ic hearing
WHEREAS, said Commission, after due inspect~on, Investigation and study made by ftse~f
and in its behalf~ and after due consideradon of all evidence and reports offered at said hea~ing, does flnd
and determine the fdlowing facts:
~. That the proposed use is prope~ty one for which a condftional use pertnit ~s authorized bY
Anaheim Municipal Code Sc+cction i8.110.070.050.0512 to permit an unmanned 420 square-foot cellular
communications facfifry wfthin an existing self-storage business with an approximate 47-toot high triangular
"monument' tower wfth twelve face-mounted antennas.
2. That the proposal is approved, in part, to permit thd request as mod~fed by the petftioner
following public notHication; and that the approved Froposal consists of an unmanned 405 sq.ft. cellular
communications faciliry wfth a 49~5-foot high monopole structur~(in~udi~nn ba ~n ~~5420 sq.ft ncell ar
and one microwave dish antenna (saplacinfl the original p po

Commis.lon has reviewed the proposa~ to permft ar. unmanned 405 square-foot cellular communicatlens

flnding that the declaration reflects the independent judgement of the lead agency and that it has
considered the NegatNe Dedaraaon together wtth any comments receNed during the public review

NOW, THEREFORE, BE I~ RESOLVED that the Anaheim Ctry Planning Commis .lon does
hereby grant subject PetRion for CondRionai Use Permit, ~n part~ upon the fdlowing conditions which are
hereby found to be a necessary prerequlsitE to the proposed use of the subJect propercy in order to
preserve the safety and general weifare of the Citizens of the Ciry of Anaheim:
1. That the cellular communications faclliry shall be approved for a pe~lod of flve (5) years, tc expire on
May 28, 2002.
2. 26, 1997 public hearing, ~shall be constructed wfth a standeard galvanized ~s eel flni h and wfthout any
microwave diah antennas.
3. That no signs, fiags, banners, or any other form of advertising shall be attached to the monopole
antenna.
4. That this property shall be developed substaMia~ly in accordance with all plans and spec~ications
submitted to the City of Anaheim by the petitioner and wiUch plans are on flle wfth the Planning
Department marked Exhibft Nos. 1, 2, 3 and 4; provided, h~nrever, that the project shall be an

Condftion No. 2, above.
5. That prior to commencement of the activity herein approved, or p~lor to flnal building and zon{ng
inspectians, c~r wfthfn a period on one (1) year from the date of this resolution, whichever occurs flrst,
Condftinn tJes. 2, 4 and 5, above-mentioned, shall be complied with.
6. Thac approval of this epplication constftutes appro~a~ of the proposed request only to the exter~t that
ft complies wich the Anaheim Municipal Zoning Code and any other appllcable City, State and Federal
regulations. Approval does not indude any action or findings as to compliance or approval of the
request regarding any other applicable ordinance, regulatlon or requiremeM.
BE IT FURTHER RESOWED that the Anaheim City Planning Commission dnes hereby flnd
and determine that adoption of this Resolutbn is expressly pred~cated upon applicanYs compliance wfth
each and all of the condft~ons hereinabove set forth. Should am~ such condftion, or any part thereot, be
Resolutionn and any approvals herein4contanined, sha~~nbe deemed nul~arxl ~~tent jurisdiction, then this
