Resolution-PC 97-67~~ ~ RESOLUTION NO. PC97-67 A RESOLUTION GF THE At~lAHEIM CITY PLANNlNG COMMISSION AMENDING CERTAIN CONDITIONS OF APPROVAL OF RESOLUTION N0. PG97-67, AL'UPTED IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 2667 WHEREAS, on FAarch ~id, 1985, the Planning Commission adopted Resolution No. PC85-73 granting Conditional Use Permit No. 266' to expand an existing private schooi to a maximum of 225 students; and that on Septembovin ~ revised~a si (Revision No. )eand amending tt e condlilonsi of Resolution No. PC85-73 by app g P~ approval in their entirety; and WHEREAS, on July 25, 1994, Commission adopted Resolution No. PC94-95 to amend the previous resolutions by fncreasino the maximum enrdlment to 257 students (Condition No. 2), approving revlssd plans to permft a 486 sq.ft. sq.ft. rr,odular classroom and a 450 sq.ft. expansion of the existing school building (Condition No. 7), waiving the minimum structural setback (Condftion No. 7), and adding nine new conditions (Condftion Nos. 10 through 18); ' WHEREAS, on October 17, 1994, the Plannin5 ~ommission adopted Resolution No. PC94- 140 to amend Condition No. 11 (pertaining to parking) and to add the following new cond'Rion: 19 of a th o al (July ~25, 1994)band shall~expire uly~2d5o1gg7e (3j years from the original date PP lNHER1IS, the petitioner has submitted a requsst to amend Condftion No. 19 to allow the modular unit to remain for an additional tive years. WHEREAS, the Ciry Planning Commission dk! hold a public hearing at the Civic Center in the Giry of Anaheim on May 28, 1997, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance wfth the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and agafnst said proposed amendment and to investigate and ma~<e f(ndfngs and recommendations in connection therewith; and WHEREAS, said Commission, after due inspectfon, investigation and study made by ftself and in fts behalf, and after due cons(deration of all evidence and reports offered at said hearing, does find and determine the following facts: i. That the proposed amendment, including the modffication of existing conditions, is reasonabiy necessary to PermR reasonable operation under the conditional use permft as granted; 2 Ti~at the existing modular unit is necessary to the ex(sting school faciliry (Fairmont Private School at 12? South CI!ron Street) for use as classroom and storage area; . 3. That no changes or modiflcations are proposed to the exist(ng modular unft and ft remains (n good condftion; and 4. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposft(on to the subJect petftion. -1- PC97-67 CR293PLWP ~ ~ rALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anahefm Ciry Planning Commission has review~d the proposal and does hereby flnd that the Negative Declaration previously approved ~n connection with Conditlonal Use Permft No. 2667 is adequate to serve as the required envfronmental documentation in connection with this request upon finding that the declaration reflects xhe independent Judgement of the lead agency and that ft has consldAred the prevfously approved NegatNe Declaration together wRh any comments receNed during the public review process and further ~nding on the basis of the initial study and any comments receNed that there is no substantial evidence that the project will have a signfficant effect on the environment. NOW, THEREFORE, BE IT RESOLVED tha4 the Anaheim City Plannfng Commission does hereby amend Condition No. 19 of Resolutton No. PC94-140, adopted in connection with Condftional Use Permft No. 2667, to read as follows: 19. That the modular unit shall be permitted for an additional period of time not tQ exceed five (5) years from the date of this resolution (May 28, 1997) and to expire on May 28, 2C~02.
