PC93-70 ADOPTED IN CONhECTION WI7hi COtdDITIONAL USE PERM~T 3fi06 WHEREAS, on June 14,1993, the Planning Commission adopted Resolution No. PC93-70, granting subject Condftional Use Permft No. 3606 to permR the on-premises sale arxi consumption of beer and wine In a prnposed restaurant in conJunction wfth the indoor swap mest for a period of one year untii June 14, 1994; and that two extenstc; s of time have been approved under ResoluNon Nos. PC94-5'rand PC95~7; and that Condkion No. 11 of Resolution No. PC95-67 states: •11. That su"~Ject use permit shall expire on June 14, 1996.' WHERFAS, th~ petitioner has submitted a letier requesting modification of sa(d Condftion Na. 11 to continue the o~-premises sale of beer and wine in the exlsting restaurant until April 22, 2001, to coincide with the exp(ration date ofi Conditional U~e ~erm1~ No. 3400 for the indoor swap meet; and WHEREAS, subject property is currently developed with a 133,200-sq. ft. indoor swap meet tmarketplace) with accessory outdoor uses in the CL (Commercial, Limited) Zone. 1A~HEREAS, the City Planning Commission did hoid a public hearing at the Civic Center in the City of Anahelm on June 9, 1997, at 1:30 p.m., notfce of said pub!ic hearing having been duly given as required by law and in accordance with thR provisicns of the Anaheim M~nicipal Code, Chapter 18.03, to hear arxi consider evidence for and aga(nst saW proposed amendment and to investigate and make findings an~l recommendations in connection therewfth; and that sakl public hearing was continued to June 23, 1997, Planning Commission meeting; and WHERF.AS, saEd Commission, after due inspection, investigation and study made by itself and in its behalf, and after due considerat(on of all evidence and reports offered at said hearing, does ~ind ~nd determine the following faMs: 1. That subject Condftfonal Use Permit No. No. 360& is being exercised in a manner not detrimec~tal to the particular area and surrounding larxi uses, nor to the public peace, health, safery and general welfare, in accordance with AM.C. Section 18.03.093.041; 2. That the restaurart with retail sales of beer and wine for on-premises consumption has exisied for three years in a manner not detrimental to the Anahefm Indoor Marketplace; and a tirne extension, concurrent witfi the time Ifmftation of the condrtfonal use permit under which Marketplace was established is appropriate tu allow for the restauranYs continued operation; and ;. Condition No. 11 of Resolution No. PC93-70, granted in connection with Conditional Use Permit No. 3606 and as amended by Resolulton Nos. PC94-57 and PC95-67, to read as follows: •11. 'fhat this conditional use permit shall expire concurrently with Conditional Use Permft No. 3400 for the Anaheim Indoor Market place, on April 22, 2001.'
