PC98-126 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSIO~ THAT PETITION FOR RECLASSIFICATION NO. 97-98-19 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for real property situated in the City of Anaheim, County of Orange, State of California, described as foilows: . THE EASTERLY 66.00 FEET OF THE WESTERLY 132.00 FEET OF THE WEST 3 ACRES OF THE SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER OF THE SUUTHEAST QUARTER OF SECTION 8, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. EXCEPT ThIE SOUTH 40 FEET THEREOF AS DEEDED TO THE STATE OF CALIFORNIA BY DEED RECORDED JULY 28, 1995, IN BOOK 3155, PAGE 147 OF OFFICIAL RECORDS. ALSO EXCEPT THEREFROM THE NOP.THERLY 420.00 FEET. WHEREAS, the City Planning Commission did hold a public hearing at tl7e Civic Center in the Ciry of Anaheim on August 17, 1998 at 1:30 p.m., r~otice of said public hearing having been ~uly given as required by law and in accordance with the provisions of fhe Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection ther~~with; and that the hearing was continued from the Commission meetings of July 6 and 6!ugust 3, 1?98; and WHEREAS, said Commission, after due inspection, investigatio~~ and study made by itself and in its behalf, and after due consideration of alf evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from the CG (Commercial, General) to the CL (Commercial, Limited) Zone. 2. That the Anaheim General Plan designates subject property for General Commercial land uses. 3. That the proposed reclassific2tion of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reciassification of subject property does properly relate to the zones and their permittec~ uses Iocally established in close proximity t~ subject property and to ;he zones and their permitted uses generally established throughout the community. 5. That no one indicated their presence at the public hearing in opposition; and that no correspondence was received (n opposition to ihis petition. CR3396PL.DOC -1- PC98-126 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposai to reclassify subject property from the CG (Commercial, General) to the CL (Commercial, Limited) Zone on a 0.3-acre parcel having a frontage of 66 feet on the north side of Lincoln Avenue, a maximum depth of 199 feet, and being located 500 feet east of Crescent Way (1777-A West Lincoln Avenue); and does hereby determined that the previously-certified EIR 307 (Plaza Redevelopment Project Environment Impact Report) is adequate to serve as the required environmental documental~on for subject request. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subjact Petition for Reclassific~tion, unconditionally, to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exciude the above-described property from the CG (Commercial, General) Zone and to incorporate said described property into the to the CL (Commercial, Limited) Zone upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: BE IT FURTHER RESOLVED, that this resolution shall not commitment by the City to rezone, the subject oroperty; any such rezoning the City Council which shall be a legislative act which may be approved or dF sole discretion. ~-. , TNE F~OREGOING RESOLUTION was August 17, 1998 - ~ -- -....
