PC98-128 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION TI-IAT PETITION FOR RECLASSIFICATION NO. 98-99-02 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for reai property situated in the City of Anaheim, County of Orange, State of California, described as follows: PARCEL 1: THE WESTERLY t00 FEET OF THE NORTHERLY 245 FEET OF THE EASTERLY 220 F[ET OF THE EAST HALF OF THE WEST HALF OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 14, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51 PAGE 11 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. PARCEL 2: THE EASTERLY 120 FEET OF THE NORTHERLY 245 FEET OF THE EAST HALF OF THE WEST HALF OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 14, TGWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51 PAGE 11 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. PARCEL 3: THE WEST HALF OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 14, TOWNSHIP 4 SOUTH, RANGE 11 WEST, S.B.B. & M. EXC~PTING THEREFROM THE NORTH 245 FEET OF THE EAST 220 FEET. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on August 17, 1998, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reciassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine lhe following facts: 1. TYiat the petitioner proposes reciassification of subject property from the RS-A-43,000 (Residential/Agricultural) Zone to lhe RS-5,000 (Residential, Single-Family) Zone or a less intense zone. 2. That the Anaheim General Plan Land Use Element designates this property for Low- Medium Density Residential land uses. CR3398PL.DOC -1- PC98-128 3. That the proposed reclassification of subje~t property is necessary and/or desirable for the orderly and proper development of the community. • 4. That the proposed reclassification of subject property does prcperly relate to the zones and their permitted uses locally estabiished in ciose proximity to subject property and to the zones and their permitted usES generally established throughout the community. 5. That one person was present at the public hearing in favor of the proposai; and one person was present at the hearing in opposition; and that no correspondence was received in opposition ta ihe petition. CALIFORNIA ENVIRONM[NTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the propusai to reclassify subject property from the RS-A-43,000 (Residential/Agricultural) Zone to the RS-5000 (Residential, Single-Family) Zone or a less intense zone on a 10.3-acre parcel located at the southeast corner of Orange AvFnue and Halliday Street with frontages of 330 feet ~n the south side of Orange Avenue and 1,350 feet on the east side Halliday Street (3038 West Orange Avenue); and does herehy approve the Negative Declaration upon finding that the declaration reflects the independent judc~ement of the lead agency and that it has considered tne Negative Declaration together with any comments rsceived during the public review process and further finding on the basis of the initial study and any comments received that there is no subs!antial evidence that the project will have a siynificant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to auihorize an amendment to the Zoning Map of the Anaheim Municipal Code io exclude the above-described property from RS-A-43,000 (Residential/Agriculturai) Zone and to incorporate said described property into the RS-5,000 (Residential, Single-Family) Zone, unconditionally.
