Resolution-PC 98-168RfS.QLUTI S,~M NC hsC.~B-16$ A RESOWTION O:~ THE AN.IHEIM CITY F~`iNNINu CGMMISSI~N Fh+.F`vDIN~ ~FS~LIlTION tQ0.5~~,:`.e~Ees 19E2•62, ADOPTEC: c~l G~NiVEi.; i tON W'."fH CONDITIONP.i. ~.ISc PERiv11T NO. 310 WHEREA:~I, on ~'>ctober 29, 1962, the Anaho~~, ; G:~ Fianni~g Commission adopted Resolution No. 518, Series 1962- 3, to aoprove Cond~liona'. .~~,P permit 1Vo. 310 to establish a ba~ik in an existing industriai building at 1025 East Oran~ethorNo r1:~sn;~o; a~id that Con~iNon No. 4 specifies that the property be deveioped substantially in accorcir•.nce :vitF~ Exhibil'Nos. 1, 2, 3 and 4(site plan, floor plan and front elevation, roof framing plan, and b~iid?n!~ .-levati~ns); ~;~d WHEREAS, the property is develop~f~ v;+iih a 24,000 sq.ft, buiiding (currently vacant but previously used as a bank) in the ML (Limited Industrial) ?~~ne; and WHEREAS, the petitioner re~uests .,pproval to retain two automated telier machines (ATMs) at the former Wells Fargo Bank at 1025 East Orangethorpe Avenue; that the faciiity consists of lwo unmanned ATPv1's machines with a inside service sr,am and an exterior interface on the east wall of the former bank building; that the facility will operate on a 24 hour basis; and lhat plans were submitted illustrating the proposal (Revision No. 1 of Exhibit No. 1 and Exhibit No. 5); and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 26, 1998 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith. WHEREAS, said Commission, after due inspection, investigation ano study made by itself and in its behalf, and after due consideration of ail evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use, two automated bank teller machines, Is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.075. 2. That the proposed use wlli not adverse;;i >7ffect the adjoining land uses and the growth and development of the area in which it is located. 3. That the size and shape of the site for the proposal is adequste to allow full development of the proposed use in a manner not detrimental to the particular area nor to lhe peace, health, safety and general welfare because the property is large enough to support the existing structure, its future office and industrial tenant(s) and the proposed ATM bank services without affecting the adjoining properties or preventing future growth or development of the surrounding induslrial neighborhood. 4. 7hat the traffic generated by the psoposed use will not impose an undue burden upon the streets and highways designed and improved to carry thQ tra~c in the area because the ATM facility will not cause an} additional burden upon the adjacent streets which serves this area. 5. That amending this conditional use permit, under the conditions imposed, will not be detrimental to the peace, b+~alth, safety and general welfare of the citizens of lhe City of Anaheim because the previous bank operations, inciuding ATM transactions, did not generated complaints due to on-site customer activities. 6. CR3463PK.DOC -1- PC98-166 CALIFORNIA ENVIRONMEN'TAL Qll~~,ll'1~' ~CT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to ama~:? the previously-app:ovEd conditional use• permit to retain two automated teller machines (ATM'sj fn a former bank buitdin~ on an irregularly-shaped 'i .67-acre property having frontage of 270 feet on the north side of Orangethorpe Ar•enue and a maximum depth of 312 feet, and being located 193 feet west of.the centerline of Raymond Avenue (former Well's Farga Bank at 1025 East Orangethorpe Avenue); and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has cons(dered the Negative Declaration together with any comments received during the pubiic review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Resolulion No. 518, Series 1962-63, adopled in connection with Conditional Use Permit No. 310, to permit two (2) automatsd teiler machines (ATM's) to rem~in in connecNon with a former bank buiiding; and BE IT FURTHER RESOLVEa that the condiqons of approval are hereby amended in their entirety to read as follows: 1. That signage for this facility shall be limited to that which fs shown on Exhibit No. 6 submitted by the petitioner. Any additional signage shall be subject to priar review and approvai by the Piannir~g Commission as ~"Reports and Recommendations" item. 2. That pians shall be submitted to the City Tra~c anci Transpartation Manager for his review and approvai showing the lacation of the ATM's and the desig~~ated customer parking spaces. Subject r.rcparty shall thereupon be developed and m2lntained in conformance with said plans. 3. That tt~is coriditional use permit shall expire five (5) years from the date of this resoiution, on October 26, 2003. 4. That within a period of ane (1) month from the date of thi~ resolution, Condition No. 2, above mentioned, sh211 be complied with, Extensions for further timo to complete said conditions may be granted in accordanco with Section 18.03.090 of the Anaheim Municipal Code. 5. That subJect property shall be devetoped substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Rc~vision No. 1 of Exhibit No. 1(site plan), and Exhibit Nos. 5(Floor plan and eievat(7n) and 6(sigr~~3g.~), and as conditioned herein. 6, That ~oproval of this ap!alication constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicabie City, State and Federal regulations. tig ~~?roval does not include any action or findings as to compliance or approval of the req~ea,~ r~y~rdi;~g any other applicable ordinance, rc;gulatfon or requirement. BE IT Fi~:~T~iER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that 2~doption of this Resolulion is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth.
