Resolution-PC 98-180RESOLUTION NO. PC98-180 A RESOLUTION ~F THE ANAHEIM CITY PLANNING COMMISSION ' THAT PETITION FOR REGLASSIFICATION NO. 98-99-07 BE GRANTED, UNCONDI710NALLY WHEREAS, the. Anaheim City Planning Commission did receive a verified petition for Reclassification for real property situated in the City of Anaheim, County of Orange, S!ate of California, described as follows: PARCELS 1 AND 2 OF PARCEL MAP NO. 79-229, IN THE CITY OF ANAHEIM, AS SHOWN ON A MAP FILED IN BOOK 166, PAGES 23 AND 24 OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAId COUNTY. WHEREAS, lhe City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 9, 1998, at 1:30 p.m., notice of said pubiic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That this petition, initiated by the City Redevelopment Agency, proposes reclassification of subject property from the Commerciai, General (CG) Zone to the Commercial, Limited (CL) Zone. That the property is partially developed with a parking lot and the remainder is vacant. 3. That the Anaheim General Plan Land Use Element designates this property for General Commercial land uses; and that the property is located in the Project Alpha Redevelopment Area. 4. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 5. That the proposed reclassification of subject property does properly reiate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 6. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT F~NDING: That the Anaheim City Planning Commission has revfewed lhe proposal to reclassify subject property from the Commercial, General (CG) zone to lhe Commercial, Limiled (CL) zone on a irregularly-shaped 1.70-acre property located at the southeast corner of Lincoln Avenue and Harbor Boulevard, and having frontages of 240 feet on the south side of Lincoln Avenue and 180 feet on lhe east side of Harbor Boulevard (100 South Harbor Boulevard); and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received fhat there is no substantial evidence that the project will have a significant effect on the environment. NOW, THERE~ORE, BG IT RESOLVED lhat the Anaheim City Planning Commissfon does hereby approve the subject Petition for Reclassification, unconditionally, to authorizo an amendment to the Zoning Map of the Anaheim Municipal Codo to exclude the above-described property from the Commercial, General (CG) Zo~e and to fncorporate said described prope~ty into the Commerciai, Limited (CL) Zone. CR3477PK.DOC -1- PC98-180 BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subJect property; any such rezoning shall require an ordinance of the City Councii which shall be a legislative act which may be approved or ~enied by the City Council at its sole discretion.
