WHEREAS, the City Planning Commission did hold a public hearing at. the Civic l~enter ir~ the City of Anaheim on November 23, 1998 at 1:30 p.m., notfce of said public heaPlhg Iial~~'"~3~b~en d_uly given as required by law and in accordance with the provisions of the Anaheim Munic'~,Bal ci;~de, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and tto invesl~,'ttate and make findings and recommendations in connection therewith; and that said hearing was continued from the mee~ing of October 12, 1996; and WHEREAS, said Commission, after due inspection, invesligation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from tha CH (Commercial Heavy) zone to the CL (Commercial, Limited) or a less intense zone. 2. That lhe Anaheim General Plan designates subject property for General Commercial land uses. CR3484PK.DOC -1- PC98-184 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. - 4. That the proposed reclassification of subject property does properly relato to the zones and their permitted uses locally established in close proximity to subJect property and to the zones and their permitted uses generally established throughout the community. 5. That no one indicated their presence at the public hearing in opposition; and that no correspondence was received fn opposition to subject petition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassiiy subject property from the CH ;Commerciai, Heavy) to ihe CL (Commerciai, Limited) Zon~ on a 1.3-acre rectangularly-shaped property having a frontage of 220 feet on the south side of Uncoln Avenue, a maximum depth oF 260 feet and being located 440 feet east of the centeriine of Euclid Street, and further described as 1652 West Lincoin Avenue (Chain Reaction); and does hereby approve ;he Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negative Declaration together with any comments receiyed during the public review process and further finding on the basis of the initial study and any comments received that there is no substantiai evidence that the project uwll have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subJect Petition for Reclassification, unconditionally, lo authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property from the CH (Gommercial, Heavy) Zone and to incorporate said described property into the CL (Commercial, Limited) Zone.
