Resolution-PC 98-191RESOLUTION Nd. PC98-191 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING RESOLUTION NO. PC93-138, ADOPTED IN CONNECTION WITH COhDITIONAL USE PERMIT NO. 1369 WHEREAS, on January 22, 1973, the Anaheim City Planning Commission adopted Resolution No. PC73-18 to grant Conditional Use Permit No. 1369 to est2blish a bus storage, service, maintenance and repair facility ~vith waiver of required enclosure of outdoor uses at 851 East Cerritos Avenue (the northwest corner of Cerritos Avenue and Lewis S4reet); and WHEREAS, this property is developed with a new and used truck sales lot and repair facility (Mack Trucks) in the ML (Limited Industrial) zone; and that the Anaheim General Plan designates the property for General Industrial land uses; and WHEREAS, the petitioner proposes delivery van storage, service, maintenance and repair in the existing 17,560 sq.ft. industrial building to replace the existing conditional use (bus storage, service, maintenance and repair facility); and that revised exhibits (Revision No. 1 of Exhibit Nos. 1, 2 and 3) were submitted; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 23, 1998 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WFIEREAS, said Commission, after due inspection, investigation and sfudy made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the follawing facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Coc!s Section 18.61.050.070 to permit delivery van storage, service, maintenance and repair in an existing 17,560 sq.ft. industrial building. 2. That lhe property supports the existing operation and that the proposal is less intense. 3. That the delivery van service and related operations will not cause any burden upon the adjacent streets which serve this area. 4. That the delivery van service, storage and maintenance will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim because there have been no complaints about the existing operation which has a larger truck service component. 5. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALIIY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit delivery van storage, service, maintenance and repair in an existing 17,560 sq.ft, industrial building to replace the existing approval for a bus storage, service, maintenance and repair faciliry on a rectangularly-shaped, 2.9-acre property is located at the northwest corner of Cerritos Avenue and Lewis Street, with frontages of 259 feet on the north side of Cerritos Avenue and 452 feet on the west side of Lewis Street (851 East Cerritos Avenue); and does hereby determine that the previously ce~tified Environmental Impact Report No. 81 is adequate to serve as the required environmental documentation for this proposal. CR3491 PK.DOC -1- PC98-191 NOW, THERE~ORE, BE IT RESOLVED that the Anaheim City Planning Commission doe.~ hereb~~ amend Resolution No. PC73-18, adopted in conneclion with Gonditional Use Permit No. 1369, to permit delivery van storage, service, maintenance and rep2ir in an existing 17,560 sq.ft. industria! building under authority Anaheim Municipal Code Section 18.61.050.070; and BE IT FURTHER RESOLVED that Condition No. 10 of said resolution be amended to read: 10. That subject property shall be developed substantially in accordance with plans and specificaiions submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Revision No. 1 of Exhibit Nos.1, 2 and 3, and as conditioned herein. BE IT FURTHEFt RESULVED that the foll~wing new oonditions be added to said resolution: 13. That trash storage areas shall be refurbished to the satisfaction of the Public Works Department, Streets and Sanitation Division, to comply with approved plans on file with said Department. _ 14. That trash enclosure gates shali be installed to the satisfaction of the Streets and Sanitation Division to comply with approved plans on file with the Public Works Department, 15. That the legal owner of subjsct property shall provide the City of Anaheim with a public utility easement, in varying widths, ta be determined when electrical design is completed. Said easement shall be submitted to the City of Anaheim prior to issuance of building permits. 16. That the numerical address in three (3) foot hign numbers shali be provided on the roof of the building in contrasting colors in a manner not visib!e to the streets, as required by the the Anaheim Police Departrrant. 17. That the outdoor van storage area shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of al pzrsons on or about the storage ares. Any new or eaisting lighting p~an shali be submitted to and approved by the Police Department. 18. That the overnight storage of vans shall be screened from view with chain-link fencing interwoven with PVC slats to match the existing fence along the west property line. 19. That the ex?sting dilapidated chain-link fence with PVC siats along the west property line shall be repaired. 20. That, where necessary, the on-site landscaping and irrigation system shall bs refurbished and maintained in compliance with City standards. 21. That signage for subject facility shail be limited to that which is shown on the exhibits submitted by the petitioner and approved by the Planning Commission. Any additional signs shall be subject to approval by the F'lanning Commission as a"Reports and Recommendations" item. 22. That prior to commencing operation of this business, a valid business license shall be obtained from the Ciry Business License Division. 23. That ttie owner of subject property shall submit a letter requesting termination of Conditional Use Permit No. 3435 (to permit a new and used truck sales lot and repair facility with waiver of required dedication and improvements and required setback) to the Zoning Division. -2- PC98-191 24. That the proposed twenty five (25) foot high pole sign is hereby approved for a period of•four (4) years, until December 13, 2002. 25. That no outdoor work on vehicles or vehicle parts shali be permitted and, further, that no outdoor work, including diagnostic services shall be conducted outdoors at any time. 26. That no required parking area shall be fenced or otherwise enclosed for outdoor storage uses. 27. That prior to commencement of the activity authorized by this resolution, or prior to issuance of a building permit, o, within a period of one (1) year from the date of this resolution, whichever occurs first, Condition I~os. 10, 13, 14, 15, 16, 17, 18, 19, 20, 22 and 23, above- mentioned, shall be complied with. Extensians for fu~ther time to complete said conditions may be granted in accordance wilh Section 18.03.090 of the Anaheim Municipal Code. 28. That approval of this application constitutes approval of the proposed request only to the exte~t that it complies with the Anaheim Municipai Zoning Code and any other applicable City, State and Federal regulations. Approvai does not include any action or findings as to compliance or approval of the request regarding any other applic2ble ordinance, rec~ulation or requirement. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applioanPs compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court ~ f competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null oid.
