Resolution-PC 98-196RESOLUTION NO. PC98-196 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION TERMINATING ALL PROCEEDIhGS IN CONNFCTION WITH CONDITIONAL USE PERMIT NOS. 2171 AND 2476 WHEREAS, on April 20, 198 ~, the Planning Commission adopted Resolution No. PC81- 79 to approve Conditional Use Permit tJo. 2171 and permit the commercial use of a residential structure at 406 West Vermont Avenue with waivers of permitted location of required parking, maximum structural height, minimum landscaped setback and minimum wali height); and WHEREAS, on August 8, 1983, the Planning Commission adopted Resolution No. PC83- 136 to grant Conditional Use Permit 2476 and permit sale of alcoholic beverages for on-premises consumption in a proposed Moose Lodge at 912, 914 and 916 South Harbor Boulevard; and WHEREAS, this property, located south and east of the southeast corner of Vermont Avenue and Harbor Boulevard, is developed with a commercial buiiding, a single family home-and a c'iurch with reciprocal parking in the CL (Commercial, Limited) zone; and that the General Plan Land Use designation for ihe property for General Commercial; and WHEREAS, on August 3, 1998, the Planning Commission adopted Resolution ~o. PC98- 113 to grant Conditional Use Permit No. 4040 and permit a day care facility with a maximum of sixty (60) children in an existing 4,785 square foot building at 912, 914 and 916 South Harbor Boulevard, and 406 West Vermont Avenue); and that Condition No. 9 of said resolution specifies the following: That the property owner shall submit a letter requesting termination of Conditionai Use Permit No. 2478 (permitting sales of beer and wine for on-premises consumption in an existing restaurant), Conditional Use Permit 2476 (permitting sales of alcoholic beverages for on-premises consumplion in a proposed Moose Lodge) and Conditional Use Permit No. 2171 (permitting the commercial use of a residential structure with waivers of permitted location of required parking, maximum structural t~eight, minimum landscape setback and minimum wall height) to the Zoning Division:' WHEREAS, Lisa Morales and Don Garcia have submitted a letter requesting termination of Conditional Use Permit Nos. 2478, 2476 and 2171 to comply with the above condition of approval; but that it has been determined that Conditional Use Permit No. 2478 (permitting sale of beer and wine for on- premises consumption in an existing restaurant) does not pertain to this property and, therefore, is not a part of this termination. NOW, THEREFORE, BE IT RESOLVED that the Anahefm City Planning Commission does hereby terminate al~ prcceedings in conneclion wi Condition I Use Permit Nos. 2171 and 2476 on the basis of lhe foregoing findings.
