PC98-200 A RESOLUTION OF THE ANAHEIA4 CITY PLANtJING COMMISSION REINSTATiNG AND APPROVING CONDITIQNAL USE PERMIT NO. 3812, AND AMENDING CERTAIN CONDITIONS OF APPROVAL OF RESOLUTION NO. PC96-26 ADOPTED THEREWITH, AS AMENDED BY RESOLUTION NO. 97-143 WHEREAS, on March 4, 1996, the Anaheim City Planning Commiss~on adopted Resolution No. PC96-26 to approve Conditional Use Permit No. 3812 and permit an automotive van conversion and modification facility at 1315-D, 1321, 1325, 1331 and 1341 North Blue Gum Street in an existing industrial business park; and WHEREAS, on October 13, 1997, the Planning Commission adopted Resolution No. PC97-143 to amend and add ce~tain conditions of approval to Resolution No. PC96-26, includinc~ the following bruo conditions: That the outdoor storage of vehicles shall occupy only those parking spaces which are in excess of Zoning Code requirements and as shown on Revision No. 1 of Exhibit No. 1, on file in tne Planning Department. 26. That lhis use permit shail expire one (1) year from the date of lhis resolution, on October 13, 1998. WHEREAS, this property is developed witha 173,650 sq.ft., 7 building industrial business park in Development Area 1(Industrial Area) of the Northeast Area Specific Plan (Specific Pian No. SP94-1), including subject business (Transtar Van Conversion); and WHEREAS, the petitioner has requested, pursuant to Code Section 18.03.092 of tha Anaheim Municipal Code, that Resolution No. PC96-26, as amended, be amended to retain the previously-approved automotive van conversion ar~d modification facility in an existing industrial bus(ness park for an additional period of time and that Condition Nos. 2 and 26 be amended accordingly; and lhat the petitioner has also indicated that the building area of this business has been reduced to 47,090 sq.ft. in Buildings B, C and D only. WHEREAS, lhe City Planning Commission did hold a publi;, hearing at the Civic ~enter in the City oF Anaheim on December 21, 1998 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance wilh the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said prooosed conditional use permit and to fnvest(gate and make findings and recommendations in connection lherewith; and WHEREAS, said Commission, aker due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That automotive van conversion and mod(fication is properly a use for whici~ a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.070. That the facts necessary to support the reinstatement of lhis conditional permft still exist. 3. That this conditional use permit is being exerc(sed in substantialiy the same manner and fn conformance with conditions and stipuiations originally approved, and in a manner that (s not detrimental to the particular area and surrounding land uses. That reinstatement of this van cc~nversion facility is limited to Buildings B, C and D, for a total of 47,090 sq.ft. as shown on Revision No. 2 of Exhibit No. 1, on file in the Planning Department; that all outdoor parking shall be Iimited to the storage areas locaied between Buildings 8 and C, Buildings C and D, and Buildings D and E; and that these outdoor storage areas shail be screened by chain link fencing with PVC slats. 5. That no one indicated their presence at the public hearing in opposition to the prc,posal; and that no corresponden ~e was received in opposition. CALIFORiV~A ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reinstaie and approve an automotive van conversion and modification facility at 1315-D, 1321, 1325, 1331 and 1341 North Blue Gum Street in an existing industrial business park located at the northwest corner of Miraloma Avenue and Blue Gum Street; and does hereby find that the approve the Negative Declaration previously approved in connection with Conditional Use Permit No. 3812 is adequate to serve as the required environmental documentation in connection with this request upon finding that that the declaration reflects the independentjudgment of the lead agency and that it has considered the previously approved Negative Declaration together with any comments received during the public review process and further finding on fhe basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Resolution No. 96-26, adopted in connection with Conditional Use Permit No. 3812 and amended by Resolution No. PC97-143, to reinstate the conditional use and retain the automotive van conversion and modification facility in an existing industr?al business park, and that the conditions of approval shall be amended as foliows: (a) That Condition Nos. 16, 17, 18 and 19 are deleted. (b) That Condition Nos. 2 and 26 are amended to read: That the van conversion facility shall be limited to Buildings B, C and D for a total of 47,090 sq.ft. as shown on Revision No. 2 of Exhibit No. 1, on file in the Planning Department. All outdoor parking shall be limited to the storage areas located tssrtv,ieen Buildings B and C, Buildings C and D, and Buildings D and E. These outdoor storage areas shall be screened by chain link fencing with PVC siats. 26. That this use permit shall expire on O~tober 13, 1999. (c) 7hat the following new condition is added: 31. That final sign plans for the van conversion facility shall be submitted to the Zoning Division of the Planning Department for review and approval by ihe Planning Commission as a"Reports and Recommendations" item. BE !T FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's complianr,e with each and all of the conditions hereinabove set foRh. Should any such condition, or any part thereof, be declared invalid or unenforceable by lhe final judgment of any court of competentjurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. -2- PC98-200 ~+ .
