PC98-203 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 4082 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described as: PARCEL A: PARCELS 1 AND 2, AS SHOWN ON A MAP FILED IN BOOK 26, PAGE 38 OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. PARCEL Q: PARCELS 1 AND 2 AS SHOWN ON A MAP FILED IN BOOK 51, PAGE 4 OF PARCEL, MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF Of~NGE COUNTY, CALIFORNIA. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on December 21, 1953 at 1:30 p.m., notice of said public hearing having been duly given as required by lav~.~ and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself ~nd ir. its behaif, and ~fter due coi;sideration of all evidence and reports offered at said hearing, does find ar~d detPrmine ihe follo~.viny f2~!~; 1. That the proposed use is properly one for which a conditional use permit is authorized by ~' naheim Municipal CodP Sections 18.05.046.020 and 18.44.067 to construct a shopping center id~e~;tifica;ion sign consisYing of a 60-foot high freestandinfl pylon sign with waivers of lhe following: (a) Sections 18.05.094.020 and 18.44.067 (b) Sections 18.05.094.030 and 18.44.067 (c) Sections 18.05.094.050 and 18.44.067 (d) SecHons 18.05.094.060 and 18.44.067 - Maximum area of sian. (250 sa.ft. permitted; 256 sa.ft, propcsed) - Permitted location of freestandinq siqn. (minimum 120•foot setback fram adjacent property lines required; none proposed from north property line) - Maximum heiaht of freestandina siqn. (25 feet permitted; 60 feet proposed) aximum sion width. 2. That waivers (a) maximum area of signs, (b) permitted location of freestanc+ing signs and (c) maximum height of freeslanding signs are hereby denied on the basis that there are no identiiable hardships or special circumstances such as size, shape, topography, location or surroundings which apply to this property as compared to any other identically zoned properties in the vicinity; and that granting these waivers would give this property special privileges not enjoyed by other properties under identical zoning classification in the vicinity. CR3408PK.doc -1- PC98-203 1 3. That waiver (d), maximum sign width, is hereby denied on the basis that it was deleted following public notification of this request. 4. That granting the proposed sign wouid adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located because the Planning Commission and City Council have indicated that a previously-proposed 50-foot high sign would be unattractive for this area and unnecessary for the success of the existing retai! home improvement store; and that a 60-toot high pylon sign would create additional sign clutter in the vicinity and would be aesthetically objection~ble. 5. That the size and shape of the ~ite proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That granting of this conditional use permit would be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 7. That the traffic yenerated by the Froposed use would impose an undue b~~rden upon the streets and highways designed and improved to carry the traffic in lhe area. 8. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FIN~ING: That Environmental Impact Report No. 319 was previously certified for this property and is adequate to serve as the environmental documentation for this proposal.
