PC98-42 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL APPROVE AN AMENDMENT TO EXHIBIT NO. 7 OF THE SANTA ANA CANYON ROAD ACCESS POINT STUDY WHEREAS, on January 11, 1966, the City Council adopted Exhibit No. 7 of the Santa Ana Canyon Access Roint Study approving, and limiting the number of, access points ~etween the Riverside- Newport Freeway interchange and Weir Canyon Road; and that said exhibit was approved as a Iogicai means of providing access to properties fronting on Santa Ana Canyon Road at such time as said properties developed with uses other than those for which they were zoned in 1966; and WHEREAS, from time to time zmendments to said Exhibit No. 7 have been approved to permit additional access points along Santa Ana Canyon Road at other logical locations ~n connection with specific development proposals; and WHEREAS, the petitioner has proposed a deve~opment inciudinq a commercial retail center and ~ self storage facility on 24.5 acres bounded by the Riverside Freeway (north}, Solomon Drive (east), Santa Ana Canyon Road (south) and Via Cortez (west); and that, except for the proposed driveway on Santa Ana Canyon Road restricted to only right turns in and out, vehicular access to the property will be from Via Cortez (which also provides access to an existing commercial development to the west); and that no vehicular access is being permitted to Solomon Drive because said street provides access to residential uses only; and WHEREAS, the City Planning Commission did ho{d a public hearing at fhe Civic Center in the City of Anaheim on March 30, 1998 at 1:3Q p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 13.03, to hear and consider evidence for and aga?nst said proposed amendment and to investigate anci make findinc~s and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed amendment to Exhibit No. 7 to p2rmit one driveway tc the property on the north side of Santa Ana Canyon Road between Via Cortez and Solomon Drive, restricted to right turns in and out, is logical because vehicular access to the subject property would otherwise be limited to Via Cortez; that said new restricted access point will provide additional safe and convenient vehicular access to this commercial property; and that the exact location of said driveway will be submitted to the City Traffic Engineer for review and approval in connection with building plans for the proposed commercial center. 2. That eight people spoke in opposition to the proposal at tiie publir, hearing; and that correspondence was received in opposition to the proposal. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the propasai to revise Exhibit No. 7 of the Santa Ana Canyon Road Access Points Study to permit one additional access point on Santa Ana Canyon Road on a 24.5-acre parcel located at the northeast corner of Via Cortez and Santa Ana Canyon Road, having frontages of 964 feet on the east side of Via Cortez, 815 feet on the north side of Santa Ana Canyon Road, 950 feet on the west side of So~omon Drive and 1,500 feet on the south side of the Riverside Freeway; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negative Deciaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. CR3218PL.DOC -1- PC98-42 hOW, TNEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend that the City Cauncil approve an amendment to Exhibit No. 7 of the Santa Ana Canyon Road Access Point Study to allow one access point to property on the north side of Santa Ana Can~~on Road between Via CorEez and Solomon Drive.
