PC98-78 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 4010 BE GRANTED, IN PART WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditior~al Use Permit for• certain real property situated in the City of Anaheim, County of Orange, State of California, described in Attachment "A": WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 11, 1998 at 1:3Q p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of fhe Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.433 to construct a 91,560 sq.ft. 1-story self-storage facility, including a 750 sq.ft. office, with waiver of the following: Sections 18.04.U60.050 - Mini;num oarkina Iot landscaoinq. 18.06.030.040 and 18.61.066.030 2. That the requested waiver is hereby denied on because a revised plan eliminating the waiver was submitted following public advertisement of this petition. 4. That the proposed use is hereby approved for a period of ten years, until May 11, 2008. 3. That th~ proposed use, under the conditions imposed, will not adversely affect the adjoining Iand uses and the growth and development of the area in which it is proposed to be located; and that submitted plans indicate enhanced landscapinc~ and a combination of masonry walls and slatted chain link fencing that will completely screen the metal storage units from nearby streets 4. That !he size and shape of the site for the proposed use is adequate to allow full development of the proposal in a manner not detrimental to the particuiar area nor to the peace, health, safety and general welfare. 5. That the traffic generated by the proposed use wiil not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That granting of this conditional use permit, under the conditions imposed, will riot be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 7. That no one indicated their presence at the public hearing in opposition; and that no correspondence was received in opposition to this subject petition. CR3284PL.DOC -1- PC98-78 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to construct a 91,560 sq.ft. 9-story self-storage facility including a 750 sq.ft. office with waiver of minimum parking lot landscaping on a 10-acre irregularly- shaped parcel Iocated at the southwest corner of Cerritos Avenue and State College Boulevard, having frontages of 220 feet on the south side of Cerritos Avenue and 225 feet on the west side of State College Boulevard, and having a maximum depth of 1,600 feet (1505 Sou!h State College Boulevard); and does hereby approve the Negative Declaration upcn finding that the declaration reflects the independent judgement of the Iead zgency and that it has considered the Negative peclaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit 4010, in part, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That this approval shall expire ten (10) years from the date of this resolution, on May 11, 2008. Any extensions of time to reinstate this use shall be subject to Anaheim Municipal Code Section 18.03.093. 2. That all storage activities shall be wholly inside the buildings. At no time shall there be any outdoor storage of material or vehicles, including boats, trailers or recreational-type vehicies, except for the loading and unloading of items being stored. 3. That the petitioner shall submit the following information to the Zoning Division for review and approval by the Planning Commission as a"Reports and Recommendations" item: - Final landscaping plans, - Lighting plans, - Sign plans, - Building wall plans, - Storage unit paint colors, and - Fencing plans. 4. (a) Tt~at plans shall be submitted to the Zoning Division showing that the masonry block wall facing State College Boulevard shall be continued westerly along the south property line to the first storage unit and along the north property line a distance of approximately two hundred seventy eight (278) feet as shown on Revision No. 1 of Exhibit No. 1. (b) That landscaping plans showing a minimum of five (5), ten by ten (10 x 10) foot, landscaped tree wells aiong the outside of the wall along the north property line shall be submitted to the Z~ning Division for review and approval by the Planning Commission as a "Reports and Recommendations" item. (~) That the petitioner shall apply for and obtain an administrative adjustment or variance to permit construction of an eight (8) foot high masonry block wall in required front setback(s). If the administrative adjustment (variance) is denied, the block wall shall be set back a minimum distance of fifty ('50) feet from ihe ultimate right-of-way along Cerritos Avenue, in accordance with tne Zoning Code requirement. (d) That clinging vines shall be planted on maximum three (3) foot centers along the exterior of all fences and walls which are visible to the public rights-of-way (State Colisge Boulevard and Cerritos Avenue). -2- PC98-78 5. That the landscaping plans shall specify a"layered" and bermed landscaped setback sdjacent to State College Boulevard and Cerritos Avenue, including one (1), minimum fifteen (15) gallon sized, tree for every twenty (20) linear feet of street frontage and min?mum one (1) gallon sized vines pianted on maximum three (3) foot centers adjacent to the street side of all block walis. Landscaping consisting of grass and/or groundcover shall be planted in the twelve (12) foot wide Critical Intersection right-ofi-way adjacent to Cerrit~s Avenue and State College Boulevard until development of the ultimate right-of-way commences. The landscaoing plans shall also identify landscaping to he installed in the ten (10) faot wide landscaped setback after Critical Intersection improvements, in conformance with Zoning Code requirements. 6. That minimum one (1) galion sized vines on maximum three (3) foot centers shall be planted, irrigated and maintained adjacent to the south side of the chainlink fence along the south property line. This information shall be specifically shown on plans submitted for building permits. 7. That the owner of this property shall be responsible for the removal of any on-site graffiti within fiventy four (24) hours of its application. 8. That any roof-mounred equipment shail be screened in accordance with Anaheim Municipal Code Section 18.61.030.100 (roof-mounted mechanicai/utility equipment). Said information shail be specifically shown on the plans submitted for building permits. 9. That prior to the commencing operation of this business, a valid business licerise shall be obtained from the Business License Division of the Anaheim Finance Department. 10. That the hours of operation shall be limited to 7 a.m. to 8 p.m., (7) seven days a week, with a maximum of three (3) employees (including two [2] managers), as sfipulated to by the petitioner. 11. That the entry gate and/or any fencing proposed in the front setbacks along State College Boulevard and Cerritos ~vcnus shall be a wrought iron type material. This information, including the color of the wrought iron, shall be shown on pians submitted to the Zoning Division for review and approval by ihe Planning Commission as a"Reports and Recommendations" item. Said information shall also be specifically shown on plans submitted for building permits. 12. That no required parking area shall be fenced or othenvise enclosed for storage or any other outdoor use. 13. That trash storage area(s) shall be provided and maintained in location(s) acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved pians on file with said Department. Said information shall be specifically shown on the plans submitted for building permits. 14. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Public Worl<s Department, Streets and Sariitation Division, for review and approval. 15. That an on-site trash truck turn-arcund area shail be provided in accordance with Engineering 5tandard Detail No. 610 and maintained to the satisfaction of the Public Works Department, Street^ and Sanitation Division. Said turn-around area shall be specifically shown on plans submitted for building permits. 16. That gates shail not be installed across any driveway or street in a manner which may adversely affect vehicular traffic in State College Boulevard or Cerritos Avenue. Installation of any gates shall conform to Engineering Standard Plan No. 609 and shall be subject to the review and approval of the City Traffic and Transportation Manager prior !o issuance of a building permit. -3- PC98-78 17. That plans shall be submitted to the City Tra~c and Transportation Manager for review and approval showing conformance with the most current versions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and drivew~y iocations. Subject property shall thereupon be deveioped and maintained in conformance with said plans. 18. That all driveways shall be constructed with ten (10) foot radiu~ curb returns as required by the City Engineer in conformance with Engineering Standard No. 137. 19. That lighting fixtures shall be down-lighted in such a ma~ner that the fixtures illuminate only the this site. This information shall be specifically shown on pians submitted for building permits. 20. That street improvement plans shall be submitted to the Public Works Department, Develapment Services Division; and a bond shall be posted to ensure that State Callege Boulevard and Cerritos Avenue ar~ widened in accordance with the Circulation Element of the Anaheim Generai Plan and as approved by the City Engineer. The sireet improvements shall be constructed prior to the commencement of the business activit~ herein approved. 21. That prior to grading pian approval, the developer shall conduct a drainage study to determine this developmenYs impact on the existing drainage system. 22. The proposed Condition No. 22 was deleted at the Planning Commission public haaring. 23. That if a fire line is required by the Anaheim Fire Department, water back flow equipment and any other large water system equipment shall b~ installed to the satisfaction of the Water Engineering Division in either (a) underground vaults or (b) behind the street setback area in a manner fully screen2d from the public streets. 24. That the subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Revision No. 1 of Exhibit No. 1, and Exhibit Nos. 2 and 3, and as conditioned herein. 25. That prior to the issuance of a building permit or withii~ a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 3, 4, 5, 6, 8, 11, 13, 14, 15, 16, 17, 19 and 20, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordancP v~ith Section 18.03.090 of the Anaheim Municipal Code. 26. That prior to final building and zoning inspections, Condition Nos. 18, 23, 24 and 27, herein- mentioned, shail be comptied with 27. That prior to occupancy. the owner of this property shall request the Zoning Division for an inspection of the property to verify that all storage units are adequately screened from the public streets (State College Boulevard and Cerritos Avenue) with appropriate landscaping and/or fences. If the inspeceion determines this condition has not been complied with, then additional screening shall be provided to the satisfaction of the Planning Department. 28 That approvai of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regula!ions. Approval does n~t include any acticn or findings as to compliance or approval of ihc request regarding any other applicable ordinance, regulation or requirement. Should any such condition, or any part thereof, be declared ir.valid or unenforceable by tha final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein containe~, shall be deemed nuli and void.
