Resolution-PC 98-88RESOLUTION NO. PC98-88 A RESOLUTION OF THE ANAHEIM CIN PLANNING COMMISSION AMENDING CERTAIN CONDITIONS OF APPROVAL OF DECISION NO. ZA93-2a, ADOPTED IN CONNECTION WITH VARIANCE NO. 4213 WHEREAS, on April 8, 1993, Variance 4213 was approved, in part, by the Zoning Administrator under Decision No. ZA93-24 to waive fhe maximum number of permitted wall signs to construct four additional wail signs for the existing food mart in a service station facility (Shell Oil Co.) located at 8275 Santa Ana Canyon Road; and that said Decision includes certain conditions of approval pertaining to the approved signs for the entire facility (service station, car wash and food mart); and WHEREAS, the underlying property is currently developed with a service station (Shefl Oil Co.) with an automated car wash and a convenience market in the CL(SC) "Commercial Limited - Scenic Corridor Overlay' Zone; and WHEREAS, the petitioner has submitted revised plans (Revision No. 1 of Exhibit Nos. 1, 2, 3 and 4) necessitating waiver of the following to construct three wall signs for the proposed expansion of the existing automatic "unattended" car wash in conjunctidn with an existing service station and convenience market: Sections 18.05.091.020 - Maximum number of wall siqns. 18.44.067 (ene wall sign permitted for each individual building unit; and 18.84.062.040 three proposed on the car wash buiiding) WHEREAS, the proposed expansion of the car wash was approved by the Planning Commission in connection with an amendment to Gonditional Use Permit No. 2844 which is being rrocessed in conjunction with this propose~ amendment to Variance No. 4213; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 27, 1998, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the prov?sions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said pruposed amendment and to investigate and make fndings and recommendations in connection therewiih; and WHEREAS, said Commission, after due ~nspection, investigation and study made by itself and in ils behalf, and after due consideraiion of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That there are special circumstances applicable to the property consisting of its topography and location which do not apply to other identically zoned properties in the vicinity because the property is Iocated at the top of a siope which makes visibilily di~cult from adjacent rights-of-way (Weir Canyon Road and the Riverside Freeway), and that this use is not located adjacent to the highway (Santa Ana Canyon Road) which provides sole access to the underlying property. 2. That stricf application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity because visibility to the property is restricted. That due to the restricted visibility to this property and based on the signs permitted herein being visibie only to the interior of the lot, additionai signs are being permitted (for the reasons discussed in Paragraph (32)(e) uf the Staff Report to the Planning Commission dated May 27, 1998); and that all signs other than those specifically permitted herein are excess and required be removed. 4. That no indicated their presence at the public hearing in opposition; and that no correspondence was received in opposition to this proposal. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposr,l to amend Variance No. 4213 and waive the maximum number of wall signs to construct three wall signs for the proposed expansion of the existing automatic unattended car wash facility in conjunction with an existing service station and convenience market; and does hereby find that the Negative Declaration previously approved in connection with this variance is adequate to s2rve as the required environmental documentation in connection with this request upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the previously approved Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the projec- will have a significant effect on the environment. NOW, THEREFORE, BE IT RESULVED that the Anaheim City Planning Commission does hereby amend Condition Nos. 1, 2 and 6 of Decision No. ZA93-24, adopted in connection with Variance No. 4213, to read as foliows: 1. That the subject property shall be develoFed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on fi!e with the Planning Department marked Revision No. 1 of Exhibit Nos. 1, 2, 3 and 4, plus the 15 Polaroid photographs i;i the petition file; provided, however, that the maximum permitted signage fcr ihe entire facility (service station, car wash and convenience market ) sh~;ll be limited to the foliowing: (a) Four (4) existing small signs on the canopy over Yhe pump islands and the food mart building: (1) Two (2) "A" signs consisting of the word "Sheil" on the east and west facing edges of the canopy, and (2) Two (2) "B" signs consisting of the Shell logo on the east and west facing edges of the canopy. (b) Fifteen (15) signs on the three (3) spandrels connecting the gasoline pumps in each island under the canopy: (1) Six (6) "C" signs consisting of fhe word "Shell" on the north and south sides of each spandrel, (2) Six (6) "D" signs consisting of the Shell logo on the north and south sides of each spandrel), and (3) Three (3) "X" signs consisting of the word "selP' on the west ends of each spandrel. -2- PC98-88 (c) Two (2) signs on the car wash: (1) One (1) sign (sign no. 1) consisting of an oval shaped, nine (9) foot by three and one-half foot (3'-6"), sign painted blue and located below the roof line of the south-facing elevation of the car wash. (2) One (1) sign (sign no. 2) consisting of a three and one-half foot (3'-6") by three and one-half foot (3'-6") Shell logo with the words "entrance" below and located on the south-facing elevation of the elliptical column of the car wash's porte cochere entrance. (d) Two {2) "H" signs on the food mart building consisting of the letters "ETD" (meaning Experience The Difference). 2. That within a period of sixty (60) days from the date of this resolution or prior to ir.stallation of the new "H" signs on the food mart building, whichever occurs first, ail of the following signs shall be removed: (a) All the pump top signs, (b) The "S" sign consisting of the words "car wash" on a small sign panel mounted on one short pole generally located on the east property line, (c) The wall sign consisting of the words "car wash" on the car wash building wall, ' (d) Ail the "P" signs consisting of the posters mounted on the food mart building walls, (~ All the "W" signs consisting of any signs located inside the windows of the food mart building and facing outward (i.e. advertising "M;;lboro"). Window signs advertising products shail not be permitted, (g) "Sign no. 3" consisting of the Shell logo located on the north elevation of the car wash building. (h) Signs added to the bottom portion of the monument sign on Santa Ana (:anyon Road, and Q) The car wash instruction sign consisting of the words "make it shine" located on a pole in the northeast corner of the property. 6. That within a period of sixty (60) days from the date of this resolution (by July 27,1998), or prior to issuance of any sign permit, or prior to installation of any new approved sign, whichever occurs first, Condition No. 2, above-mentioned, shall be complied with.
