A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS IN CONNECTION WITH
CONDITIONAL USE PERMiT NOS. X-2, 1414, 3344, 3791 AND 3834, AND VARIANCE NO. 4162
WHEREAS, on March 7, 1955, Conditional Use Permit No. X-2 was granted under
Resolution No. 103, Series 1954-55, by the Anaheim Planning Commissian to permit a drive-in theater
soukheast of the intersection of OrangethorpQ Avenue and Lemon Street; and
WHEREAS, on August 20, 1973, Conditional Use Permit No. 1414 was granted under
Resolution No. PC73-190 by the Planning Commission to permil expansion of the existing drive-in theater
with waiver of required block wall surrounding outdoor uses; and that said resolution was amended in its
entirety by Resolution No. PC76-42; and
WHEREAS, on October 8, 1990 , Conditional Use Permit No. 3344 was granted, in part,
under Resolution No. PC90-240 by the Pl2nning Commission to permit an outdoor swap meet at 1520
North Lemon Street with waiver of minimum landscaped setback adjacent to Lemon Street; and that said
resolution was amended in connection with Resolution No. PC94-86; and
WHEREAS, on October 16, 1995, Conditional Use Permit No. 3791 was granted under
Resolution No. PC95-133 by the Planning Commission to permit an outdoor rolier hockey facilify in
conjunction with the existing ouldoor swap meet; and lhat said resolution was amended in connection
with Resolution No. PC96-38; and
WHEREAS, on May 29, 1996, Conditional Use Permit No. 3834 was granted, in part,
under Resoiution No. PC96-46 by the Planning Commission to permit a multi-screen theater and
entertainnent complex inciuding two full-service restaurants and Qne drive-through restaurant, and with
waivers of minimum structural setback, maximum number of free-standin~ signs, minimum distance
between freestanding signs, required parking lot landscaping and maximum number of roof signs; and
that Condition No. 15 of said resolution required that the petitioner request termination of Conditional Use
Permit Nos. X-2, 1414, 3344 and 3791, and Variance No. 4162; and
WHEREAS, on December 16, 1991, Variance No. 4162 was granted under Resulution
No. PC91-206 by the Planning Commission for waivers of required improvement of setback areas and
required screening of parking areas to establish 30 additional parking spaces for the outdoor swap
meeUdrive-in theater; and
WHEREAS, the underlying property is vacant and zoned ML (Limited Industrial); and
WHEREAS, Deena Goldwater, Vice President of California Drive-In Theatre, Inc., has
requested termination of Conditfonal Use Permit Nos. X-2, 1414, 3344 and 3791, and Variance No. 4162
to comply with Condition No. 15 of Conditional Use Permit No. 3834; and that Jay SwPrdlow, Executive
Vice President of Pacific Theaters, has requested termination of Conditional Use Permit No. 3834 to
comply with Condition No. 28 of Conditional Use Permit No. 3994 which permits an outdoor swap meet
market ~lace with waiver of minimum parking lot landscaping and pernitted encroachments into setback
areas.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Ciry Planning Commiss(on
does hereby terrninate all proceedings in connection with Conditional Use Permit Nos. X-2, 1414, 3344,
3%91 and 3834, and Variance No. 4162 on the bas(s of the foregoing findings.
