OF THE ANAHEIM ClTY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 99-00-01 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for real property situated in the City of Anaheim, County of Orange, State of Califomia, described as follows: LOTS 1 AND 2, TRACT 3267, AS PER MAP RECORDED IN BOOK 102, PAGES 41 AND 42 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. WHEREAS, the City Planning Commission did hold a pubiic hearing at the Civic Center in the City of Anaheim on July 19, 1999 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to (nvestigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That this proposai is a City-initiated reclassification of the subject properties from the CG (Commercial, General) Zone to the CL (Commercial, Limited) Zone. 2. That the Anaheirn General Plan designates subject properties for General Commercial land usos. 3. That the proposed reclassification oF subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassiflcation of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5. That no ono indicated their presence at the public hearing in opposition to subject petition; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL ~UALITY ACT FINDING: That the Anahefm City Planning Commission has reviewed ths proposal to reclassify subject property from the CG (Commercial, General) Zone to the CL (Commercial, Limited) Zone on a rectangularly-shaped 0.37 acre property located at the southeast corner of Orangewood Avenue and Mallul Drive, having frontages of 123 feet on the south side of Orangewood Avenue and 130 feet on the east side of Mallul Drive (524, 626, 628, 630, 632, 634, and 636 West Orangewood Avenue); and does hereby approve the Negative Declaration upon finding that the deciaration reflects the independent Judgment of the lead agency and that it has considered the Negative Deciaratfon together with any comments received during the publfc review process and further finding on the basis of the initial study and any comments received that there is no substantiai evidence that the project will have a signiflcant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification, unconditionally, to authorize an amendment to the Zoning Map of the Anaheim Municfpal Code to exclude tho above-described property from the CG CR3G94PK.DOC -1- PC99-133 (Commercial, General) Zone and to fncorporate saio r4 -c~?5ed property into the CL (Commercial, Limited) Zone. BE IT FURTHER RESOLVED, that this resolution shall not const(tute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an o[dinance of the City Councfl which shall be a legislative act which may be approved or denied by the City Council at its sole discretion.
