PC~9-134 A RESOLUTION UF THE ANAHEIM ClTY ~LF+NNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 99-00-d2 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Pianning Commission did receive a verified petition for Reclassification for real property situated fn the City of Anaheim, County of Orange, State of Califomia, described as follows: THAT PORTION OF LOT 16 OF THE ORANGEWOOD TRACT DESCRIBED AS: BEGINNING AT THE NORTHEAST CORNER OF LOT 16,293 FEET TO THE IR~N PIPE; THENCE WEST 285 FEET PARALLEL TO THE NOR'fH LINE OF LOT 16 TO THE IRON PIPE; THENCE NORTH 293 FEET PARALLEL TO THE EAST LINE OF LOT 16 TO ORANGEWOOD AVENUE; THENCE EAST 285 FEET TO THE POINT OF BEGINNING, CONTAINING 1.92 ACRES M~RE OR LESS. LOT 16 OF THE ORANGEWOOD TRACT, EXCEPTING 1.92 ACRES, BEGINNING AT THE NORTHEAST CORNER OF LOT 16; THEfVCE SOUTH ALONG 1'HE EAST LINE 293 FEET TO AN IRON PIPE; THENCE WEST 285 FEET PARALLEL TO THE NORTH LINE; THENCE TO AN IRON PIPE; THENCE NORTH 293 FEET PARALLEL TO THE EAST LINE OF ORANGEWOOD AVENUE; THENCE EAST 285 FEET TO THE POINT OF BEGINNING, BEING FURTHER DESCRIBED AS THE SOUTHEf,ST CORNER OF ORANGEWOOU AVENUE AND HASTER STREET. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on July 19,1999 at 1:30 p.m., notice of said public hearing having been duly g'.ven as required by law and in accordance with the provis(ons of the Anaheim Municipal Code, ~hapte~ 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings an~+ recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts; 1. That the petitioner proposes reclassification of subject property from the RM-1200 (Residential, Multiple-Family} and RS-A 43,000 (Residential/Agricultural) Zones to the OS (Open Space) Zone. . 2. The Anahe(m General Plan desfgnates subject property as a Neighborhood Park Site. 3. That the proposed reclassification of subJect property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses Iocaily established in close proximity to subject property and to the zones and their permitted uses generally estabifshed lhroughout the community. 6. That n~ one (ndicated their presence at the public hesring fn opposition ta subject petition; and that no correspondence in opposition was rece(ved, CR3695PK.DOC -1- PC99_134 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify subject property from the RM-1200 (Residential, Multiple-Family) and RS-A 43,000 (Residential/Ag~icultural) Zones to the OS (Open Space) Zone on a rectangularly-shaped 8.6 acre property located at the southeast comer of Orangewood Avenue and Haster Street, and having frontages cf 610 feet on the south side of Orangewood Avenue and 620 feet on the east side of Haster Street (Ponderosa Park); and does hereby approve the Negative Deciaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the publfc review process and further finding o~ the basis of the fnitial study and any comments received that there is no substantial evidence that the pro;ect wiil have a s(gn(flcant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subJect Petition for ReclassiBcation, unconditionaliy, to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property from the RM- 1200 (Residential, Niultiple-Family) Zone and the RS-A 43,OU0 (ResidentiallAgricultural) Zone and to incorporate said described property into the OS (Open Space) Zone. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shail require an ordinance of the City Council whfch shali be a leg(slative act which may be approved or ~enied by the City Council at its sole discretion.
