PC99-142 A RESOLUTION ~F THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECL/',SSIFICATION N0. ~~~-99-14 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did receive a verified petition for aeclassification for reai property situated in the City of Ahaheim, County of OrangE, State of California, described as follows: THAT PORTION OF THE SOUTHWEST QUARTER OF THE NOR7HWEST QUARTER OF SECTION 8, TOWNSHIP 4 SOUTH, RANGE 10 WE~T, SAN BERNARDINO BASE AND MERIDIAN, IN THE CITY OF ANAHEIM, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE WEST LINE OF SAID NORTIiWEST QUARTER 306.92 FEET NOR7H OF THE SOUTHWEST CORNER OF SAID NORTHWEST QUARTER, THENCE NORTH ALONG SAID WEST LINE 167.75 FEET, MORE OR LESS, TO A POINT 16 FEET SOUTH OF THE LINE OF 7HE NORTH 25 ACRES OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SAID SECTION 8; THENCE EAST, PARALLEL WITH SAID SOUTH LINE OF SAID NORTH 25 ACRES, 238 FEET; THENCE SOUTH, PARALLEL WITH THE WEST LINE OF SAID NORTHWEST QUARTER, 168.15 FEET TO 1"HE NORTHEAST CORNER OF THE LAND CONVEYED TO FRANCES L. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on August 2, 1999 at 1:30 p.m„ notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hea~ and consider evidence for and against said proposed rECiassification ar~i to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itsplf and in its behalf, and after due consideration of ail evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject propcrty from the RM-1200 (Residential, Mulkiple-Family) and ML (Limited Industrial) Zones to the CL (Commerciai, Limited) Zone. 2. That thc Anaheim General Plan designates subject property for General Commercial land uses. 3. That the proposed reclassification of subject property is necessary andlor desirable for 4he orderly and proper development of the community. 4. That the proposed rzcla~sification of subject property does properly relate to the zones and their p~rmitted uses Iocally e~tablished in close proximiry to subject property and to the zones and their permitted uses generali~ established throughout the communiry. 5. That one concerned person spoke at the public hearin~ regarding the proposaf and no one indicated their presence in oppasition; and that no correspondence was received in opposition. CR3705PK.DOC -1- PC99-142 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposai to reclassify subject property from the RM-1200 (Residential, MulBple-Family) and NfL (Limited industrial) Zones ta the CL {Commercial, Limited) Zone on a 4.8-acre irregulariy-shaped property located ai the southeast comer of Gramercy Avenue and Brookhurst Street, and having frontages of 893 feet on th~ south side of Gramercy Avenue and 392 feet on the east side of Brookhurst Street (600 - 626 North Brookhurst Street); and does hereby approve the Negative Declaration upon finding that t~~~ deciaratior~ reflects the independent judgment of the lead agency and that it has considered the Negauve Declaration together with any aomments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOWED that the Anaheim City Planning Commission daes hereby approve the subject Peti6an for Reclassification, unconditionaily, to authorize an amendment to the Zoning Map of the Anaheim Municipai Code to exclude the above-described property from the RM- 1200 (Residential, PAultiple-Family) and ML (Limited Industrial) Zones and to inco.rporate said described property fnto the CL (Commercial, Limited) Zone. BE IT FURTHER RESOLVED, that this resolution shali not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shal~ re.;uire an ordinance of the City Council which shall be a legislative act which may be approved or denied by the City Council at its sole discretion.
