PC99-151 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMiV11SSI0N THAT PETITION FOR RECLASSIFICATION N0. 98-99-15 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for real property situated in the City of Anaheim, County of Orange, State of Califomia, ~escribed as follows: THE SOUTH 235.52 FEET OF THE WE5T 7 ACRES OF THE SOUTH HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 13, IN TOWNSHIP 4 SOUTH, RANGE 11 1NEST, fN THE RANCHO LOS COYOTES, IN THE CITY OF ANAHEIM, COUNTY, OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP RECGRDED IN BOOK 51, PAGE(S) 11, MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, LYING WESTERLY OF THE EAST LINE OF THE WEST 464.20 FEET, MEASURED ALONG THE SOUTHERLY LINE THEREOF; EXCEPT THEREFROM THE WEST 92.00 FEET THEREOF, GRANTED TO THE STATE OF CALIFORNIA BY DEED RECORDED AUGUST 23, 1951 IN BOOK 2220 PAGE 426, OFFICIAL RECORDS, IN THE OFF~CE OF THE COUNTY RECORDER OF SAID COUNTY. ALSO EXCEPT THEREFROM THE EAST 150 FEET OF THE WEST 242 FEET OF THE SOUTH 200 FEET OF THE SOUTH HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 13, IN TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11, MISCELLANEOUS MAPS, !N THE OFFICE OF THE COUNTY RECORDER OF SAID COUPlTY. 11~/HEREAS, the City Plan~ing Commission did hold a public hearing at the Civic Center in the City of Anaheim on August 16, 1999 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and that the public hearing was continued from the Commission meeting of July 7, 1999; and WHERE'~S, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of aii evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed reclassification of subject property from the CH (Commeraial, Heavy) Zone to the CL ~Commercial, Limited) Zone or a less intense zone was initiated by the City of Anaheim. 2. The Anaheim General Plan designates this property for General Commercial land uses; and that the preperty is located in the West Anaheim Commercial Corridors Redevelopment Project Area and Community Planning Area No. 3. 3. That the pro~osed reclassi~cation of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly reiate to the zones and their permitted uses locally established in close proximity to this property and to the zones and their permitted uses gener~ily established throughout the community. That the proposed reclassification is compatible with surrounding zoning designations; that approval will establish consistent land use and site development standards for the area and is in accordance with the Planning Commission and City Council policy of reclassifying CG (Commercial, General) and CH (Commerciai, Heavy) zoned properties to the CL (Commercial, Limited) Zone. and 6. That no one indicated their presence at the public hearing in opposition to the proposa~; and that no carrespondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Gommission has reviewed the proposai to reclassify subject property from the CH (Commercial, Heavy) to the CL (Commercial, Limited) or a less intense zone on property consisting of a 1.1 acre irregularly-shaped parcei located north and east of the northeast corner of Ball Road and Beach Boulevard with frontages of 220 feet on the north side of Ball Road and 45 feet on the east side of Beach Boulevard and being located 200 feet north of the centerline of Ball Road and 245 feet east of the centeriine of Beach Boulevard, and further described as 926 South Beach Boulevard (Lyndy's M~tel and Restaurant); and does hereby approve the Negative Declaration upon finding that the declaration refiects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of th~ initial study and any comments received that there is no substantial evidence that the project will have a~ significant effect on the environment. NOW, THEREFORE, BE 17 RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification, uriconditionally, to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property from the CH (Commercial, Heavy) Zone. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the ~ity to rezone, the subject property; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approved or denied by the Ciry Councii at its sole discretion.
