Resolution-PC 99-155RESOLUTION N0. PC99-155 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING RESOLUTION NO. PC97-180, ADOPTEQ II~ CONNECTION WITH CONDITIONAL USE PERMIT NO. 3991 WHEREAS, on December 22, 1997, Resolution No. PC97-180 was adopted by the Planning Commission to grant Conditional Use Permit No. 3991 and permit construction of a women's rehabilitation center in cor~junction with the existing Salvation Army men's rehabilitation center and work therapy unit, and with waiver of minirnum nuinber of parking spaces at 1300 South Lewis Street; and WHEREAS, this property is currently developed with the Saivation Army men's rehab'litation center and ~vork therapy unit located in the ML (Limited Industrialj zone; and that the Anaheim General Plan designates this site for Genera! Industral land uses; and WHEREAS, the petitioner requests amendment to this conditional use permit under the authority of Code Section 18.03.092 to revise plans and combine construction of the previously-approved women's rehabilitation center with the existing Salvation Army men's rehabilitation center and work therapy unit; and WHEREAS, the City Planning Commission did hoid a pubiic hearing at the Civic Center in the City of Anaheim on August 16, 1999 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code. 2. That the revised plans for the proposed women's rehabilitation facility are the same size, scale and layout as the originally-approved plans. 3. That the proposed women's rehabilitation faciiity wili operate under the same guidelines as previously-approved; and that the existing men's rehabilitation and work therapy faciliry continues to operate in a manner that is not detrimental to the surrounding properties nor is it detrimental to the peace, health, safery and general welfare of the citizen's of the Ciry of Anaheim. 4. That the revised site plan is suitable to the s;te and ailows for future development of the vacant land located to the south of the proposed faciliry. 5. That the proposed modification is necessary to permit reasonable operation under the conditional use permit as originaliy granted. 6. That no one indicated their presence at the public hearing (n opposition to the proposal; and that no correspondence was received in opposition. CR3727PK.DOC -1- PC99-155 _, CALIFORNIA ENVIRONMENTAL QUALIT'Y ACT FINDING: That the Anaheim City Planning Commission has reviewed the request for approval of revised plans to combine construction of a previously-approved women's rehabilitation center with the existing Salvation Army men's rehabilitation center and work therapy unit on a 14.5-acre irregularly-shaped property having a frontage of 1130 feet on the east side of Lewis Street, a maximum depth of 435 feet and being located 820 feet north of the centerline of Cerritos Avenue (1300 South Lewis Street); and does hereby find that the Negat(ve Declaration previously approved in connection with Conditionel Use Permit No. 3991 is adequate to serve ss the required environmental documentation in connection with this request upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the previously approved Negative Declaration together with any comments received during the pubic review process and furiher finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend subject Canditional Use Permit No. 3991 to approve the revised plans to combine construction of the previously-approved women's rehabilitation center with the existing Salvation Army men's rehabilitation center and work therapy unit; and BE IT FURTHER RESOLVED that the Anaheim Ciry Planning Commission does hereby amend certain conditions of approval of Resolution No. PC97-180, adopted in connection with Conditional Use Permit No. 3991, to read as follows: That the proposed women's residence is approved solely in conjunction with the existing rehabilitation center. The proposed use of the property shall be limited to that stated in the letter of operation (dated June 25, 1999 and attached to the Staff Report to the Planning Commission, Item No. 11, dated August 16, 1999). If the existing rehabilitation center should cease operation, the buildings on this property shall not be used for any other residentiai uses. That subject oroperty sha!! be developed substantially in conformance with plans and specifications submitted to the Ciry of Anaheim by the petitioner and which plans ar2 on file with the Planning Department marked Revision No. 1 of Exhibit No. 1, Exhibit Nos. 2 and 3, and Revision No. 1 of Exhibit Nos. 4 and 5, and as conditioned herein. AND BE IT FURTHER RESOLVED that the Planning Commission does hereby add the following new condition of approvai: 12. Thak securiry doors shall be provided between the men's residence and the proposed women's residence; and that plans for said door and security procedures shall be submitted for review and approval by the Anaheim Police Department prior to the issuance of a building permit.
