A RESOLUTION OF THE PLANNING COMMISSICN OF THE C1TY OF
ANAHEIM VALIDATING THE CONTINUED USE CF MASTER
ENVIRONMENTAL IMPACT REPORT NO. 313 AND MlTIGATION
MONITORING PROGRAM NO. 0085 (THE ANAHEIM RESORT
SPECIFIC PLAN NO. 92-2).
WHEREAS, in conformance with the requirements of the Califomia Environmental
Quality Act of 1970, as amended, ("CEQA") and the State of California Guidelines for Implementation of
CEQA (the "State Guidelines"), the City Council of the City ofAnaheim, by its Resolution No. 94R-234,
certified Environmental Impact Report No. 313, adopted a Statement of Overriding Considerations and
adopted Mitigation Monitoring Program No. 0085 to serve as the required environmental documentation
for certain discretionary actions described therein (the "discretionary actions"); and
WHEREAS, pursuant to Section 15179, of the State G~~idelines, EIR No. 313 was
reviewed in The Anaheim Resort Speci~c Plan Master ElR No. 3i3 Validafion Report (hereinafter
"Validation Report"), a copy of which is on file in the Planning Dapartment and incorporated herein by this
reference; and
WHEREAS, the Ciry of Anaheim desires and intends to continue to use EIR No. 313 as
the environmental documentation required by CEQA and the State Guidelines for projects (as defined by
CEQA) within the Anaheim Resoct Specific Plan Area and for related discretionary acUons; and
WHEREAS, the Validation Report has been provided to the Planning Commission of the
City of Anaheim for review and considera;ion prior to the continued use of EIR No. 313; and
WHEREAS, the Planning Commission concurs with the conclusion of the Report that
WHEREAS, baaed upon its review of the Validation RPport and consideration of
information and evidence provided, the Planning Commission finds that no substantial changes have
occurred with respect to the circumstances under which the Master EIR was certified, and that there is no
new available material information which was not known and could not have been known at the time the
Master EIR was certified.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Ciry of
An2heim that the City of Anaheim does hereby validate the continued use of EIR No. 313, in compliance
with CEQA and the State Guidelines based upon the Statements of Findings of Fact, Statement of
Overriding Considerations and Mitigation Monitoring Program No. 0085 approved by the City Council of
the City of Anaheim on Septembe~~ 20, 1994.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
August 30, 1999.
