PC99-166 A RESOLUTION QF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 4150 BE GRANTED, IN PART, FOR THREE (3) YEARS WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described as: PARCELI: LOTS 13 AND 14 IN BLOCK "B" OF TRACT NO. 143 WILKE ADDITION, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP RECORDED IN BOOK 11 PAGE 38 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. EXCEPT THE EASTERLY 5.25 FEET. PARCEL 2: LOT 15 IN BLOCK "B: OF TRACT NO. 143, WILKE ADDITION, AS SHOWN ON A MAP RECORDED IN BOOK 11 PAGE 38 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. EXCEPT THE INTEREST OF THE CITY OF ANAHEIM IN THE EASTERLY 5.25 FEET AS DESCRIBED IN DEED RECORDED IN BOOK 913 PAGE 443, OFFICIAL RECORDS. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 13, 1999 at 1:30 p.m., notice of said pubiic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipai Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behaif, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipai Code Section 18.45.050.085 to permit and retain an automotive stereo and alarm sales and installation facility with waiver of the following: Sections 18.06.050.02Q.022 - Minimum number of oarkinn saaces. 18.b6.050.020.022.0222 • and 18.45.066.050 2. That the waiver of minimum number of parking spaces is hereby denied on the basis that it was deleted following public notification. 3. That the proposal will not adversely affect the adjoining land uses and the growth and development of the area in which it is located. CR3746PK.DOC -1- PC99-166 4. That the size and shape of the site for the proposal is adequate to allow the development of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 5. That the traffic generated by the proposal will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That granting of this conditional use permit, under the conditions imposed, will not be detrimental to tiie peace, health, safety and general welfare of the citizens of the City af Anaheim. 7. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALIIY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit and retain an automotive stereo and alarm sales and installation facility with waiver of minimum number of parking spaces on a irregularly-shaped 0.35-acre prope~ty located at the northwest corner of La Verne Street and Anaheim Boulevard with frontages of 103 feet on the north side of La Verne Street and 150 feet on the west side of Anaheim Boulevard, and further described as 909 North Anaheim Boulevard (The Car Stereo Warehouse); and does hereby approve the Negative Declaratien upon finding that the declaration reflects the ir.dependent judgment of the lead agency and that it has considzred the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit for three (3) years, upon the foliowing conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. 7hat no outdoor storage or work on vehicles or vehicular parts shall be permitted. 2. That the owner of subject property shall submit ~ letter to the Zoning Division requesting termination of Conditional Use Permit No. 3648 (to permit an automotive tire sales and installation facility with waiver of minimum number of parking spaces at 909 North Anaheim Boulevard). 3. That three (3) foot high street address numbers shall be displayed on the roof of the building in a color contrasting to the roof material. The numbers shall not be visible to adjacent streets or properties. 4. That the property shall be permanently maintained in an orderly fashion through the provision of regular landscaping maintenance, removal of trash or debris, and removal of graffiti within twenty four (24) hours from time of occurrence. 5. That a minimum ten (10) foot wide landscaped and irrigated planter strip shall be instalied adjacent to Anaheim Boulevard and a minimum five (5) foot wide landscaped strip shall be installed adjacent to La Verne Street, exclusive of driveway openings; and that within a period of two (2) months from the date of this resolution, a landscaping plan specifying the type, size and location of existing and refurbished landscaping and the irrigation system for the entire site shall be submitted to the Zoning Division of the Planning Department for review and approval. Within two (2) months following approval of the landscaping plan(s), the landscaping shall be planted and thereafter maintained in accordance with the landscaping pian. 6. That wall signage for subject facility shall be limited to the existing wall signs on the east, south and north building elevations; and that no painted wall signs be permitted on any building GR3746PK.DOC -Z- PC99-166 elevation. Any additional signs shall be subm3tted to the Zoning Division for review and approval by the Planning Commission as a"Reports and Recommendations item " 7. That plans shall be submitted to the City Traffic and Transportation Manager for review and approvai showing conformance with the most current versions of Engineering Standard P!an Nos. 436 and 602 pertaining to parking standards and driveway locations. Subject property shail thereupon be developed and maintained in conformance with said plans. 8. That all business activities shall be conducted wholly inside the building. 9. That subject business shall be limited to the sales and installation of stereo and alarms equipment, which is purchased only on the subject property. 10. That there shall be no testing of stereo or alarm equipment which is audible outside the building. 11. That there shall be a maximum of six (&) employees during any one shift; and that the hours of operation shall be limited to the following Monday through Friday: 9 a.m. to 8 p.m. Saturday and Sunday: 10 a.m. to 5 p.m. 12. That staff radios shall not be audible outside the building. 13. That this Conditional Use Permit No. 4150 shall expire three (3) years from the date of this resolution, on September 13, 2002. 14. That no public telephones or vending machines shall be permitted outside the buifding. 15. That no window signs shali be psrmitted. 16. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitinner and which plans are on file with the Planning Department marked Exhibit No. 1, and as conditioned herein. 17. That Condition Nos. 2, 3, 5, 7 and 16, above-mentioned, shall be completed with two (2) months from the date of this resolution. Extensions for further tirr~e to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 18. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicanYs compliance with gach and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competentjurisdiction, then this Resolution, and any approvals herein contained, shail be deemed nuil and void.
