PC99-185 A RESOLUTION OF THE ANAHEIM CiTY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT N0. 4152 BE GRANTED V~IHEREAa, the Anaheim City Plan~ing Commission did receive a verified PetitiQn for Conditiona{ Use Permit for certain real property situated in the Ciry of Anaheim, County of Orange, State of California, described as: PARCEL 10, AS SHOWN ON A MAP FILED IN BOOK 222, PAGAES 37 TO 41 INCLUSIVE OF PA~CCEL MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA, AND AS CORRECTED BY THAT CERTAIN CERTIFICATE OF CORRECTION RECORDED DECEMBER 15, 1989 AS INSTRUMENT N0. 89- 680795 OF OFFICIAL RECORDS OF SAID ORANGE COUNTY. WHFREAS, the Ciry Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 25, 1999 at'l:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and that the public hearing was continued from the Commission meetings of August 30, September 13, and September 27, 1999; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of ail evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use pennit is authorized by Anaheim Municipai Code Section 18.03.030.010 to construct a guide sign for the Festival Regional Shopping Center. 2. That the proposed use, a guide sign for a regional shopping center across the street on the south side of Santa Ana Canyon Road, is not listed in the Zoning Code as being a permitted use in the underlying CL(SC) "Commercial, Limited-Scenic Corridor Overlay" Zone. 3. That the proposed use, as approved, is for a 45-foot high sign as shown on the revised exhibit which was submitted at the public hearing. 4. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 5. That the size and shape of the site for the proposed use is adequate to allow fuli development of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 6. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the tra~c in the area. 7. That granting this conditional use permit, under the condi:ions imposed, will not be detrimentai to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 8. That one person indicated their presence at said public hearing in opposition to the proposal; and that correspondence was received in opposition. CR3795PK.DOC -1- PC99-185 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to construct a guide sign for the Festival Regionai Shopping Center on a 3.9-acre, irregularly-shaped property located between the SR 91/Riverside Freeway and Santa Ana Canyon Road, having a frontage of 1,490 feet on the north side of Santa Ana Canyon Road, a maximum depth of 110 feet and being located 1,320 feet west of the cer.terline of Rooseveit Road; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no subsiantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit No. 4152, upon the following conditions :vhich are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That any required relocation of City etectrical facilities shall be at the deveioper's expense. All required clearances must be maintained for overhead utility lines. 2. That the base of the sign shall be covered with a real stone venee,r base and not with concrete paintE~ to simulate stone. Said information shall be specificaily :shown o~i plans submitted to the City of Anaheim for permits. 3. That said sign shall be limited to one (1) double-faced shopping center identific~tion sign with a total tieight of forty nine (49) feet; and inciuding the logo ~~nd name of the center, "Anaheim Hills Festival," and six (6) major Festival tenant identification s;gns with a total maximum sign area (in~luding the space between each tenant sign) of three Iwndred forty two (342) feet with overall sign copy dimensions of nineteen (19) feet high by eighb~en (18) feet wide as shown on Revision No. 1 of Exhibit No. 2. Said tenant signs shall match thei colors shown on said Revision No. 1 of Exhibit No. 2 and shall not include corporate identificatien colors. Said information shall be shown on plans submitted to the Building Division for permits. Any changes to the approved exhibit shall be submitted to the Planning Commission for review and approval as a"Reports and Recommendations" item. 4. That the property shall be permanently maintained in an orderiy fashion through the provision of regular landscaping maintenance, removal of trash or debris, and removal of gra~ti within twenty four (24) hours from time of occurrence. 5. That the sign shall be permanently maintained in a"like new" condition through the prr,vision of reguiar maintenance, including painting, copy repair, and lighting repair on a reyuiar t~asis. Ail un- utilized signage sha!I be pron~ptly and properly removed to prevent unsightly sign remnants. 6. That the intensity of the lighting (internal and external) of the sign shall be reviewed by s~^ff at a nighttime inspection. If the intensity is unreasonably bright, said intens~ty shall be adjusted. Staffs decision may be appealed to the Planning Commission for consideration as a"Reports and Recommendations" item. 7. That no temporary advertising devices or materials shall be attached to the sign. 8. That subject property shall be developed substantially in accordance with plans and specificatians submitted to the City of Ar,:~he~m by the petitioner and which plans are on fiie with the Planning department marked Exhibit No. 1, Revision tVo. 1 of Exhibit No. 2, and Fxhibit No. 3, and as conditioned herein. 9. That prior to issuance of a permit by the Buiiding Division or ~~~ithin a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. ?. and 3, above-mentioned, shali be CR3795PK.DOC -2- PC99-185 complied with. Exter~sions for further time to complete said condiUons may be granted in accordance with SECtion 18.03.090 c~f the Maheim Municipai Code. 10. That prior to final building and zo~ing inspections, Condition Nos. 7 and 8, above-mentioned, shail be complied with. 11. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federa! regulations. Approval does not inciude any action or findings as to compliance or approval of the request regarding any other applicablz ordinance, regulation or requirement. 12. That any specimen tree removed from the property shall be replaced in compiiance with Code requirements. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicanYs compiiance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereQf, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals her~in contained, shall be deemed null and void.
