PC97-124, ADOPTED IN CONNECTION WITH CJNDITIONAL USE PER~i i N0. 3962 WHEREAS, on September 3, 1997, Resolution No. PC97-124 was adopted by the Planning Commission to grant Conditional Use Permit No. 3962 and permit construction of a 70,825 sq.ft., 2-level automobi~e sales and service faciliry with accessory parts sales, an interior showroom, service bays, and outdoor vehicle dispiay/parking areas, including a second level, and with waivers of minimun7 parking tot landscaping, permitted freestanding signs, and permitted wall signs at 1001 North Weir Canyon Road; and WHEREAS, this property is developed with an automobile sales faciliry (Classic Chevrolet) in the CL(SC) zone; that the Anaheim General Plan :.and Use E!ement designates this property for General Commercial land uses; and that the property is located within the River Valley Redevelopment Project Area; :.nd WHEREAS, the petitioner requests an amendmen: to this conditional use permit for approval of the following waivers to permit revisions to the sign plan (proposed Revision 1 of Exhibit Nos. 7 and S, pages a through e) for the previously-approved a::!o dealership: (a) Sections 18.05.091.010.011 - 18.05.091.010.014 18.44.067 and 18.84.062.040 (b) Sections 18.05.091.030 18.44.067 and 18.84.062.040 Permitted freestandina sivns. (maximum 26 sa.ft. sinale-taced sign permitted; 36 sa.ft. double-faced sign proposed Permitted directional siqns. (maximum 3-foot wide directional signs with the words "enter" and "exi " permitted; 4-foot. 5-inch wide with various text proposed WHEREAS, the City Ptanning Commission did hold a public hearing at the Civic Center fn the City of Anaheim on November 22, 1999 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Munfcipal Code, Chapter 18.03, to hear and consiaer evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connectian therewith; and WHEREAS, sa(d Commi~ssion, after due inspection, investigation and stud,y made by itself and in its behalf, and after due consideration of all evidence and reports offered at safd hearing, does find and determfne the following facts: 1. That the proposed waivers are authorized by the Anaheim Municfpal Code for sfgns (n the CL(SC) "Commercial, Limited - Scenic Corridor Overlay" zone. 2. That waiver (a), permitted freestanding signs, is hereby approved on the basis that the property is unique since it has four street frontages and needs additional directional signage to guide fts consumers; and that nearby propQrty to the north fn the same zone has been granted a similarwaiver. 3. That waiver (b), permitted directional signs, is hereby approved on the bas(s that on the basis that there are other properties with a sfmilar sign in the immediate vicinity and (n the same zoning; and that this property is unfque because of its four street frontages and its need for adequate identification. ~ Cr3813PK.DOC -1- PC99-207 4. That the Community Development Department has revieweti the prcposal, which is located in the River Valley Redevelopment Project Area, and concurs with the request. 5. That the proposed modifications, including the two waivers, are necessary to permit reasonable operation under the conditionai use permit as originally granted. 6. That amending this conditional use permit, under the conditions imposed, will not be detrimental to the peace, health, safety and general weifare of the Citizens of the City of Anaheim. 7. That no one indicated their presence at the public hearing in opposition to the proposal; and that ro correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the request for waivers of permitted freestanding signs and permitted directional signs to permit sign pian revisions for an existing auto dealership on a 2.95-acre irregularly- shaped property located on the east side of Pullman Street between Savi Ranch Parkway and Old Canal Road, having frontages of 193 feet on the west side of Weir Canyon Road, 600 feet on the south side of Savi Ranch Parkway, 224 feet on the east side of Pullman Street and 647 feet on the north side of Old Canal Road, and further described as 1001 North Weir Canyon Road (Classic Chevrolet); and does hereby find that the Negative Deciaration previously approved in connection with this req~est upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the previously approved Negative Declaration together wi!h any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project wil~ have a significant ~affect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Resolution No. PC97-124, adopted in connection with Conditional Use Permit No. 3962, to approve the following waivers to permit sign plan revisions for the previousiy-approved and existing auto dealership: (a) Sections 18.05.091.010.011 - Permitted freestandina siqns. 18.05.091.010.014 (maximum 26 sa.ft. sinQie-faced sign permitted; 18.44.067 36 sa.ft. doubie-faced sign proposed and 18.84.062.040 (b) Sections 18.05.091.030 - Permitted directional sgns. 18.44.067 (mzximum 3-foot wide directional signs with the words "enter" and 18.84.062.040 ~ and "exit" or "in and ouY' permitted; , 4-foot. 5-inch wide with various text proposed BE i'f FURTHER RESOLVED that the Anaheim Ciry Planning Commission does hereby delete Condition No. 21(c) of said Resolution No. PC97-124; and BE IT FURTHER RESOLVED that the Anaheim Ciry Planring Commission does hereby amend certain conditions of said Resolution No. PC97-124, to read as follows: 21(d) That the monument sign shall be limited to a maximurn thirty six (36) sq. ft. in size, eight (8) feet high, seven (7) feet wide, double-faced sign, labeled Revision No. 1 of Exhibit No. 7. Said sign shall be located in a landscaped area and, if illuminated, shall be turned off at midnight as ~equired by Code Section 18.05.091.050 "Limitations on Sign Lighting." 31. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2, 3, 4, 5, 6 and 9, and Revision No. 1 of Exhibit Nos. 7 and 8, pages a through e; CR3813PK.DOC -2- PC99-207 provided, however, that the directional sign located adjacent to the north property line shall be moved five (5) feet to the east of the driveway on Savi Ranch Parkway subject ;o compliance with Zoning Code requirement~ for lines-of-sight; and as conditioned herein.
