PC99-212 A RESOLI;TION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 3490 BE REVOKED WHEREAS, on February 24, 1992, the Anaheim City Planning Commission adopted Resolution No. PC92-20 to grant Conditional Use Permit No. 3490 Gnd permit the on-premises consumption of alcoholic beverages in conjunction with a semi-enclosed restaurant and with waiver of minimum landscaped setback adJacent to a scenic highway on property located at 701 South Weir Canyon Road, Suite 101; and WHEREAS, 701 South Weir Canyon Road, Suite 101, is developed with Blockbuster Video and is located in the Sycamore Canyon Plaza shopping center; that the property is in Development Area 2 of the Sycamore Cany~n Specific Plan (SP 88-1); that Development Area 2 is intended for the development of retail commercial and/or office commercial uses, and Blockbus~er Video is a permitted use; and that the Anaheim General Plan Land Use Element designates this property for General Commercial land uses; and WHEREAS, on September 13, 1999, the Planning Commission initiated revocation proceedings because the premises for which this conditional use permit was approved are no longer being ufilized for a restaurar.t with on-premises consumption of alcoholic beverages; and WHEREAS, the City Planning Commission did hold a puuiic hearing at the Civic Center in the City of Anaheim on December 6, 1999 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accardance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed revocation and/or modification, and to investigate and make findings and recommendations in connection therewith; and that said public hearing was continued from the November 22, 1999 Plannfng Commission meeting; and WHEREAS, said Commission, after due inspection, investigation and study mado by itself and in its behalf, and after due consideration of all evidence and reports offered at said hE+aring, including the December 6, 1999 Staff Report to the Planning Commission does find and determine the following facts: 1. That this conditional use permit is hereby revoked based upon evidence submitted at the public hearing, including that the staff report, that the use for which the approval was oric~inally granted has ceased to exist for a period of six (6) consecutive months or more. 2. That one person spoke at the public hearing in opposition to the proposed revocation; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: The Planning Directoi•'s authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 21, as defined in the State of Califernia Environmental lmpact RepoR (EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby revoke subJect Conditional Use Permit 3490, on the basis of the aforementioned findings.
