Resolution-PC 99-30RESOLUTION NC~. PC99-30 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING RESOLUTION NO. PC97-30, ADOPTED IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 3919 WHEREAS, on March 17, 1997, Resolution No. PC97-30 was adopted by the Anaheim City Planning Commissian to grant Conditional Use Permit No. 3919, in part, and permit a 15,050 sq.ft., two-level, automobile sales and service facility with accessory parts sales, an interior showroom, 11 service bays, roof-mounted equipment, and outdoor at-grade and second level vehicle display/storage areas with v~aivers of permitted freestanding sign and permitted wall signs (waiver of permitted directional signs was denied) at 8200-8250 Crystal Drive; and WHEREAS, Condition Nos. 18 and 26 of said resolution pertain to the approved sir~ns for the business; and WHEREAS, this property is developed with an automobile sales and repair facility (Anaheim Hills Pontiac, GMC and Bu?ck) with accessory parts sales in the CL(SC) (Commercial, Limited - Scenic Corridor Overlay) zone; that the Anaheim General Plan designates the property for General Commercial land uses; and that the property is located in the Rive:- Valley Redevelopment Project Area; and WHEREAS, the petitioner has requested to amend or delete certain conditions of approval to permit sign plan revisions and waivers of permitted freestanding signs and permitted directional signs to modify previously-approved signs and to install an additional directional sign; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on February 17, 1999 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner requests (1) amendment or deletion of certain conditions of approval of Conditional Use Permit No. 3919 and (2) approval of the following waivers to modify previously-approved signs and to install an additional directional ~ign for an existing automotive dealership: (a) Sections 18.05.091.010.011 • Permitted freestandina sians. 18.05.091.010.014 (26 sa.ft. sinale-faced sign permitted; and 18.44.067 41 sa.ft. double-faced sign proposed) (b) Sections 18.05.091.030 - Permitted directional sians. and 18.44.067 (maximum 3-foot wide signs with the words "enter" and "exiP' permitted; 4-foot. 5-inch wide signs with various text proposed) 2. That tl-~ere are special ~ircumstances applicabie to the property such as size, shape, topography, Iocation or surroundings which do not apply to other identically zoned properties in the vicinity. 3. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties under identical zoning classification in the vicinity. CR3563PK.DOC -1- PC99-30 4. That no one indicated their presence at the public hearing i~ opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the request for (1) amendment or deietion of certain conditions of approval pertaining to signage and (2) waivers of permitted freestanding signs and permitted directional s~gns to permit sign plan revisions and an additional directional sign for an existing auto dealership on a rectangularly-shaped 2.3-acre property located on the east side of Pullman Street between Crystal Drive and Savi Ranch Parkway, with a frontages of 148 feet on the east side of Pullman Street, 340 feet on lhe south side of Crystal Drive and 317 feet on the north side of Savi Ranch Parkway, and further described as 8200 East Crystal Drive (Anaheim Hills Pontiac, GMC and Buick); and does hereby determine that ihe Negative Declaration previously approved in connection with Conditional Use Permit No. 3919 is adequate to serve as the required documentation in connection with this request upon finding that the declaration reflects the independent judgment of the lead agency and that it has cons~dered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that lhere is no substantial evidence that the proposal will have a significant effect on the environment. NOW, Tt-IEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Resolution No. PC97-30, adopted in connection with Conditional Use Permit No. 3919, as follows: 1. Approve the following waivers to revise the previously-approved signs and to permit one additional directional sign: (a) Sections 18.05.091.010.U11 - 18.05.091.010.014 and 18.44.067 Permitted freestandinp sions. (26 sa.ft. sinaie-faced sign permitted; 41 sq.ft. double-faced sign proposed) (b) Sections 18.05.091.030 and 18.44.06% 2. Amend Condition Nos. 18 and 26 to read: Permitted directional sians. (maximum 3-foot wide signs with the words "enter" and "exiY' permitted; 4-foot. 5-inch wide signs with various text proposed) 18. That signage for this facility shall be limited to that which is shown on the exhibits submitted by the petitioner; provided, however, that there shall be no more than three (3) directional sigr~s for the business, one (1) each at the two (2) driveways on Crystal Drive and one (1) at the driveway on Savi Ranch Parkway, in accordance with Code Subsection 18.05.091.030. Any additional signage shall be subject to the prior approval of the Planning Commission as a"Reports and Recomrnendations" item. 26. That subject property shall be deve~oped substantiaily in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 5; Revision No. 1 of Exhibit No. 6, pages 1 through 4; and Exhibit No. 7; provided, however, that there shall be no more than three (3) directional signs for this business, one (1) each at the two (2) driveways on Crystal Drive and one (1) at the driveway on Savi Ranch Parkway, in accordance with Code Subsection ~ 8.05.091.030. 3. Add the following new co~~d~tion: 30. That roof-mounted hot air balloons or other inflatable devices shall not be permitted. -2- PC99-30 BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of tiiis Resolution is expressly predicated upon appiicanfs compliance with each and ail of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invaiid or unenforceabte by the final judgment of any court of c mpetent jurisdiction, then this Resolution, and any approvals herein contained, shall be dee ed null a id.
