PC99-73 A RESOLUTION OF THE ANAHEIM CiTY PLANNING COMMISSION THF.T PrTITION FOR CONDITIONAL USE PERMIT NO. 4117 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition For Conditional Use Permit for certain real property situated in the Cir~r of Anaheim, County of Orange, State of California, described as: THE SOUTH 150.24 FEET OF THE NORTH 216.24 FEET OF THE WEST HALF OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHWES'f QUARTER OF SECTION 17, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO ~OS COYOTES, CITY OF ANAHEIM, AS PFR MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE OFFICE OF THE COUNTY RECORDER OF SAID ORANGE COUNTY. EXCEPT THE EAST 14.~0 FEET THEREOF. ALSO EXCEPT THE WEST 120.00 FEET THEREOF. WHEREAS, the City Pl2nning Commission did hold a public hearing at the Civic Center in the City of Araheim on May 10, 1999 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions ofi the Anahsim Wtunicipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation ard study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That although the proposed pawnshop is properly a use for wt~ich a condition~l use permit is authorized by Anaheim Municipal Code Section 18.44.050.210 in the (;L (Commercial, Limited) zone, it is specifically prohibited in the Brookhurst Community Corridor Overlay Zone where this properiy is also located, under Code Section 18.55.0441.12G. That the proposed use is hereby denied. 3. That the proposed use would adversely affect the adjoining land uses and the growth and developmeni of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for the use is not adequate to allow the fuN development of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. That the traffic gene~ated by the proposed use wouid impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 7. That no one indicated their presence at the public hearing in opposition; and that no correspondence was received in opposi!ion to tho subject petition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim Ciry Planning Commission has reviewed the proposal to establish a pawn shop in conjunction with an existing jewelry/coin shop on a 0.91-acre rectangularly-shaped proFerty located at the southeast corner of Lincoln Avenue and Empire Street with frontages of 263 feet on the south side of Lincoln Avenue and 150 feet on the east side of Empire Street, addressed at 2060 West Lincoln Avenue (Hallock Coin Jewelry); and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and ary comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional Use Permit n the basis of the aforementioned findings.
