PC99-74 A RESOLUTION OF THE ANAHEIM CITl' PLANNING COMMISSION AMENDING THE CONDITIC~NS dF APPROVAL OF RESOLUTION NO. 184, SERIES 195?-58, AP7D RESOLUTION NO. 123, SERIES ?961-62, ADOPTED IPd CONNECTION WITH CONDITIONAL JSE PERMIT NOS. 15 AND 172 WNEREAS, on February 3, 1958, the Anaheim City Pianning Commission adopted Resolution No. 184, Series •i957-5f3, to grant Conditional Use Permit No. 15 to expand an existing trailer park at 501 East Orangethorpe Avenue; and WHEREAS, on October 30, 1961, the Anaheim City Planning Commission adopted Resolution No. 123, Series 1961-62, to grant Conditional Use Permit No. 172 and permit a trailer park on the north side of Orangethorpe Avenue between Lemon Street and Raymond Avenue; and WHEREAS, this property is developed with the Rancho La Paz Mobile Home Park; that the property is located in the PD-C(MHP) "Parking District - Commercial, Mobile Home Park Overiay" and ML(MHP) "Limited Industriai, Mobiie Home Park Overlay" zones; and that the General Plan land use designation is General Industrial; and WHEREAS, the petitioner has requested amendments to the conditions of approval of both cond?tional use permits pertaining to the relocation of the main entrance to the mobile home park from Orangethorpe Avenue; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 10, 1999, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Cornmission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of ail evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposal to amend the conditions of approval of the lwo subject conditional use permits to add conditions pertaining to relocating the main entrance to the existing mobile home p~rk from Orangethorpe Avenue is authorized by Section 18.03.092 of the Anaheim Municipal Code which provides for the modification of conditional use permits. 2. That the proposed emendment, consisting of the imposition of an additional conditi~ns to each conditional use permit, is reasonabiy necessary to protect the public peace, health, safety or general weifare, and necessary to permit reasonable operation under the conditional use permits as originally granted. 3. That the existing use is properly one for which a conditionaf use permit is authorized by the Zoning Code. 4. That the proposed amendment will not adversely affect the adjoining land uses and lhe growth and development of th~ area in which the use is located, 5. That the size and shape of the site for the proposed amendment is adequate to allow the full developmeni of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. That the traffic generated by the existing use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because the relocated driveway is at a location with a tra~c signal. 7. That the amending these conditional use permits will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 8. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTA~ QUALITY ACT FINDlNG: That the Anaheim City Planning Commission has reviewed the proposal to amend these conditional use permits by adding a new condition of approval to each pe~taining to the relocation of the main entrance to the existing mobile home park located on an irregularly-shaped, 24.87-acre property having a frontage of 595 feet on the narth side of Orangethorpe Avenue, a maximum depth of 1,270 feet, being located 1,440 feet west of the canterline of Raymond Avenue, and further described 2~ 501 East Orangethorpe Avenue {Rancho La Paz Mobiie Home Park); and does hereby approve the Negative Declaration upon finding tha: the declaration refle~ts the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effi~:::;n the environment. NOW, THEREFORE, BE IT i2ESOLVED that the Anaheim City Planning Commission does hereby amend Resolution No. 184, series 1957-58, adopted in connection with Conditional Use Permit No. 15, add the following ne~v condition: "2. The existing main entrance to the mobile hame park from Orangethorpe Avenue shall be gated and closed, and shall remain closed at all times except when necessary: to provide access to vehicles providing emergency services to the mobile home park or its residents; to move mobile homes in and out of the park, and/or to provide access to the mobile home park from Easi Orangethorpe Avenue during any period when the Cypress Street entrance is closed and passage is not possible:' BE IT FURTHER RESOLVED that the City Planning Commission does hereby amend Resolution No. 123, series 1961-62, adopted in connection with Conditional Use Permit No. 172, to add the following new condition: "4. The existing main entrance to th2 mobiie home park from Orangethorpe Avenue shail be gated and closed, and shall remain clased at all times except when necessary: to provide access to vehicl2s providing emergency services to the mobile home park or its residents; to move mobile homes in and out of the park;; and to provide access to the mobile home park from East Orangethorpe Avenue during any period when the Cypress Street entrance is closed and passage ~-not possible."
