WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 10, 1999 at 1:30 p.m., notice of sa~d public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, c'hapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itseif and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That this reclassification is a City-initiated reclassification of the subject properties from the CH (Commercial, Heavy) Zone to the CL (Commercial, Limited) Zone uses. That the Anaheim General Plan designates subje~t property for General Commercial land 3. That the proposed reclassification of subject property is necessary andlor desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses Iocally established in close proximity to subject property and to the zones and their permitted uses generaily established throughout the community. 5. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has rEViewed the proposal to reclassify subject property from the CH (Commercial, Heavy) Zone to the CL (Commercial, Limited) Zone; that the property (consisting of three sep~rate parcels totaling 4.46 acres) is described as Parcel A, a rectangularly-shaped 0.96-acre parcel having a frontage of 160 feet on the east side of Beach Boulevard, a maximum depth of 272 feet, being located 610 feet north of the centerline of Lincoln Avenue and further described as 220 North Beach Boulevard), Parcel B, an irregularly-shaped 2.98-acre parcel having a frontage of 420 feet on the east side of Beach Boulevard, a maximum depth of 272 feet, being located 190 feet north of the centerline of Lincoln Avenue and further described as 200 North Beach Boulevard, and Parcel C, a rectanguiarly-shaped 0.52-acre parcel located at the northeast corner of Beach Boulevard and Lincoln Avenue with frontages of 150 feet on the east side of Beach Boulevard and 150 feet an the north side of Lincoln Avenue and further described as 100 North Beach Boulevard; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantia! evidence that the project will have a significant effect on the environment. cr3627PK.DOC -2- PC99-76 NOW, THEREFORE, BE IT RESOL'VED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to authorize an amendment to the "Loning Map of the Ar~aheim Municipal Code to exclude the abnve-described property from the CH (Commercial, Heavy) Zone znd to incorporate said described property into the CL (Commercial, Limited) Zone, unconditionally, BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approv~~d ur denied by the City Council at its sole discretion.
