PC9Pi-9 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION RECOMMENDING THAT THE C,'ITY COUNCIL {A) CERTIFY FINAL ENVIRUNMENTAL I~~APACT REPORT NO. 321, INCLUDING PUBLIC FACI~ ITIES PLAN, (B) ADOPT A STATEMENT OF FINbINGS AND FACTS AND A STATEMENT OF OVERRIDING CONSIDERATIONS IN CONNECTION THEREWITH, AND (C) ADOPT MITIGATION MONITOizING PROGRAM NO. 106 WHEREAS, General Plan Amendment No. 361, the Anaheim Stadium Area ~laster Land Use Plan, and proposed amendments to Title 18 "Zoning" to add a new chapter titled "Sports Entertainment Overlay (SE) Zone" and to amend certain other chapters have been prepared 2nd are on fiie with the Planning Department, including the nature, size and intensity of all existing and proposed land uses with the purpose of enhancing, guiding and regulating fut~~re deveiopmert within lhe 807-acre area Anaheim Stadium Area including the Edison international Fieid of Anaheim and the Arrowhead Pond of Anaheim (aiso known as the Anaheim Sladium Business Center), more specificaily described as that area bounded by the Santa Ana River on the east, the Anaheim City limits on the south, ihe Santa Ana Freeway (Interstate 5) on tlie west, and the Southern California Edison Co. right-of-~vay on the north; and WHEREAS, the Anaheim Stadium Area Master Land Use Plan does not alter the zoning for the property subject to these plans; and adoption of amendments to Titie 18 "Zoning" of the Anaheim Municlpai Code and subsequent approval of a resolution of intent to the Sports Entertainr*~ent Overlay (SE) Zone under a reclassification will not alter the zoning for property subject to these plans; and that implementation of zoning will take placs when owners of property specifically request that an ordinance be adopted to include their property in the Sports Entertainment Overlay (SE) Zone; and WHEREAS, the City of Anaheim is the lead agency for the preparation and consideration of environmental documents for General Plan Amendment No. 361, the Anaheim Stadium Area Master Land Use Pian, lhe Sports Enlertainment Overlay (SE) Zone and a reclassification establishing a resolution of intent to the (SE) Overlay Zone (the "ProjecP'), as the term "project" is defined in the California Environmental Quality Act of 1970 (hereinafter "CEQA"), as amended, and the State of CaH(ornia Guideiines for the Impiementation of lhe California Environmental Quality Act (hereinafter "State Guidelines"); and WHEREAS, the Project is subject to compliance with the provisions of CEQA and the State Guidelines have been considered in connection with the following discretionary actions by the City of Anaheim: (i) General Pian Amendment No. 361, (ii) the Anaheim Stadium Area Master Land Use Plan, (iii) the draft Sports Entertainment Overlay (SE) Zone and (iv) future discretionary actions described in Draft Environmentai Impact Report No. 321 ("Draft EIR") (cullectively referred to herein as the "discretionary actions"); and WHEREAS, the City of:lnaheim has prepared, or caused to be prepared, the Draft EIR and has consulted with other pubic agencies and the generai public, and given tl~em an opportunity to comment on said Draft EIR as required by the provisions of CEQA and the State Guidelines; and WHEREAS, the City of Anaheim has evaluated the comments received from public agencies and persons who reviewed the Draft EIR and has prepared responses to the comrrents received during the public review period; and WHEREAS, said comments and recommendations received on the Draft EIR, either verbatim or in summary, a list of persons, organizations and public agencies commenting on the Draft CR3529AS.DOC -1- FC93-9 EIR, and the responses cf lhe City of Anaheim to significant environmental points raised in the review and consultation process hsve been attached to and made a part of said Draft EIR to form the Final Environmentai Impact Report ("Final EIR") for said project as required by Section 15132 oF the State CEQA Guidelines; and WHEREAS, the City of Anaheim desires and intends to use Final EIR 321 as the environmental documentation required by CEQA and the State Guidelines fer each of the above- referenced discretionary actions to the extent authorized by law; and WHEREAS, said Final EIR has been presented to the City Planning Commission at a public hearing on January 2C, 1999 at 1:30 p.m., at the Civic Center in the City of Anaheim for review and consideration prior to the final approval of, and commitment to, General Plan Amendment No. 361, the Anaheim Stadium Area Master Land Use Plan, and proposed amendments to Title 18 "Zoning" to add a new chapter titled "Sports Entertainment Overiay (SE) Zone" and to amend certain other chapters. Notice of said public hearing having been duly given as required by law and in accordance with the provisions of CEQA, to hear and consider evidence for and aga(nst the Project and to investigate and make finding~ and recommendations in connection therewith; and that said public hearing was continued from the December 21, 1998 Planning Commission meeting; and NOW, THEREFORE, BE IT RESOLVED that ihe Anaheim City Planning Commission dces hereby recommend that the City Council certify Final Environmental Impact Report No. 321, adopting the attached Statement of Findings of Fact and Statement of Overriding Considerations, a copy of each of which is attached hereto marked Attachment A, and that Planning Commission incorporates said Attachment herein by this reference as if set forth (n full herein, and determines that said Final Environmental Impact Report No. 321 fuily complies with CEQA, re`lects the independent judgment of the Planning Commission, and is adequate to serve as the environmental documentation for the discretionary actions. BE IT FURTHER RESOLVED that pursuant to Section 21081.6 of thP Public Resources Code, the Planning Commission hereby recommends that the City Council adopt lhat certain monitoring proc~ram described as the "Mitigation Moniloring Program No. 106 for Anaheim Stadium Area Master Land Use Plan, a copy of which is attached hereto marked Attachment "B," and the Planning Commission incorporates said monitoring program herein by this reference as if set forth in full herein, and has included the proJect design features and mitigation measures in the N,itigation Monitoring Program as conditions oF approval required for implementation of the Anaheim St dium Area Master Land Use Plan.
