Resolution-PC 99-92RESOLUTION NO. PC99-92 A NUNC PRO TUNC RESOLUTION OF THE ANAHEIM CIN PLANNING COMMISSION AMENDING RESOLUTION NO. PC89-77 ADOPTED IN CONJUNCTION WITH CEQA MITIGATED NEGATIVE aECLr^.~'~ATION/MITIGATION MONITORING PLAN NO. 004 WHEREAS, on May 19, 1999, the Anaheirn City Planning Commission found and recommended that the City Council determine that the Mitigate~i Negative C~eclaration and Mitigation Monitoring Plan No. 004, including the associated errata, are adequate to serve as the required environmental documentation for General Plan Amendment No. 359, Amendment No. 4 to The Oisneylan~ Resort Specific Plan No. 92-1 (including amendments to the Zoning and Development Standards, the Design Plan and Guidelines and the Public Facilities Plan), Conditional Use Permit No. 4078 with Waiver of Code Requirement, and an Amendmert to the Anaheim Resort Public Realm Landscape Program by Resolution No. PC99-77; and WHEREAS, through inadvertence and clerical error, the first Noise mitigation measur~ on Page 9 and the last measure on Page 11 of A4itigation Monitoring Plan No. 004, identified as Attachment A to Resolution No. PC99-77, contain a reference to "family entertainment center' which should be deleted and the measures corrected to read as follows: (Page 9) "The design and orientation of any use, such as those which could involve amplified live music and open-air festival events, shall be reviewed by a certified acoustica! engineer. The property owner/developer shall submit a report, for review and approval by the City, to ensure that noise from areas which involve live amplified music and/or open-air festival events, do not exceed the noise levels established by the City of Anaheim Sound Pressure Level Ordinance:' (Page 11) "The property owneddeveloper shall provide for the following: cleaning of all paved areas not maintained by the City of Anaheim including, but not limited to, private streets and parkin~ lots on not Iess than a monthly basis. Using water to clean streets, parking lots, and other areas shall be allowed on a periodic basis if allo~ved in the applicanPs NPDES permit. Nightly washdown shall be allowed where advisable to maintain safe and sanitary• working conditions, if allowed in the property owner/developer's and Cfty's NPDES permit. Flushing debris, residue, and sediment down the storm drains shall conform to the property owneddeveloper's NPDES requirements. Property owner/developer agrees that material deposited fn City storm drains shall not be in violat(on of the City's NPDES permit:' NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Reso~ution No. PC99-77, nunc pro tunc, to delete the references to "family entertainment cente~' on pages 9 and 11 of Mitigation Monitoring Plan No. 004 (identified as Attachment A to said Resolution).
