2005-131RESOLUTION N0, 2005- 131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM RATIFYING AND APPROVING THE AWARD OF AN EMERGENCY CONTRACT FOR THE STABILIZATION OF RAMSGATE DRIVE AND THE PROTECTION OF PUBLIC UTILITIES THEREIN WHEREAS, on February 9, 2005, a Proclamation of Local Emergency was issued with respect to land movements in the area of Ramsgate Drive and Hidden Grove Lane within the City of Anaheim; and WHEREAS, the City Council of the City of Anaheim, through the adoption of Resolutions Number 2005-17 and 2005-27, ratified said Proclamation of Local Emergency; and WHEREAS, the protection of the public utilities within Ramsgate Drive require that Ramsgate Drive be reinforced and stabilized following said earth movement; and WHEREAS, such stabilization will in turn allow the reconstruction, debris removal and recontouring of properties along Ramsgate Drive and the clearing of obstructions in Hidden Grove Lane prior to the upcoming rainy season without endangering the public utilities within Ramsgate Drive; and WHEREAS, the City Manager has acted under the emergency powers granted to him to award a contract for the stabilization of Ramsgate Drive and the utilities therein within the time dictated by the need to perform such work immediately as a prerequisite to the reconstruction and the removal of debris from the land movement and to take maximum advantage of the present availability of necessary materiel and current interval prior to the rainy season; and WHEREAS, section 1211 of Article XII of the Charter of the City of Anaheim ("Charter") provides that upon a finding that the work involved is of urgent necessity for the preservation of life, health or property, the City Council may ratify by a vote of 213 of its membership the award of such emergency work to be performed without competitive bidding; and WHEREAS, the City Manager conducted informal bidding among qualified contractors immediately available to perform the work and has awarded the work to the lowest bidder. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM AS FOLLOWS: 1. Upon information available and presented to it, the City Council finds that the stabilization of Ramsgate Drive is a matter of urgent necessity for the preservation of life, health or property in and around the area affected by the Proclamation of Local Emergency. 2, The award of a contract for the stabilization of Ramsgate Drive to the ~, C, Baldwin Construction Company under the urgency provisions of Section 1211 of Article XII of the Charter in the amount of $2,146,000.27 is hereby approved and ratified under the terms and conditions agreed to by the City Manager. 3.
