RESOLUTION NO. 82R-40l
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO.
2344.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit from
ANGELO CASELLA and ROSA MARY CASELLA ULIVI, owners, and CHRIS and
RALPH STELLA, agents, to permit an automotive repair business in an
existing gasoline service station located on certain real property
situated within the City of Anaheim, County of Orange, State of
California and legally described as:
A PORTION OF LOT 7, BLOCK 5, OF THE GOLDEN STATE
TRACT, SHOWN AS PARCEL 4, OF PARCEL MAPS, BOOK 50,
PAGE 17, OFFICIAL RECORDS OF ORANGE COUNTY,
CALIFORNIA AS PER CORPORATION QUITCLAIM DEED RECORDED
IN BOOK 13793 PAGE 96 OF OFFICIAL RECORDS OF ORANGE
COUNTY, CALIFORNIA; and

WIIEREAS, the City Planning Commission did hold a public
hearing upon said application at the City Hall in the City of
Anaheim, notices of which public hearing were duly given as re-
quired by law and the provisions of Title 18, Chapter 18.03 of the
Anaheim Municipal Code, and
WHEREAS, said Commission, after due inspection, investi-
gation and s~udies made by i~8elf and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. PC82-ll8, qrantinq
Conditional Use Permit No. 2344 J and
MIEREAS, thereafter, within the time prescribed by law,
an interested party or ~he City Council, on i~s own .mo~ion, caused
the review of said Planning Commission action at a duly noticed
pUblic hearing, and
WlIEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct .uch hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports, and
~IEREAS, the City Council finds, after careful consider-
ation of the recommendations of the City Planning Commission and
all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a conditional
use pe~it is authorized by the Anaheim Municipal Code.
2. The proposed use will not adversely affect the adjoining
land uses and the growth and development of the area in which it
is proposed to be located.
3. The size and shape of the site proposed for the use is .
adequate to allow the full development of the proposed use in a
manner not detrimental to the particular,area nor to the peace,
health, safety and general welfare.
4. The traffic generated by the proposed use will not im-
pose an undue burden upon the streets and highways designed and
improved ~ carry the traffic in the area.
s. The granting of the conditional use permit under the
conditions imposed will no~ be de~rimen~al to ~e peace, health,
safety and general welfare of the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commission
firantinq said conditional use pe~it be, and the same 1s
ereby, affirmed and that Conditional Use Permit Ro. 2344 be,
and the same is hereby, qranted pe~itting an automotive repair
business on the hereinabove described real property subject to
the following conditions:

1. That trash storage areas shall be provided in accordance
with approved plans on file with the Office of the Executive Director
of Public Works.
2. That the owners of subject property shall submit a letter
requesting termination of Conditional Use Permit Nos. 2085 and 2218
and Variance No. 3200 to the Planning Department.
3. That the petitioner shall obtain approval for temporary use
of the trailer located on the property in conformance with Council
Policy Number 529, within a period of 60 days from the date herein.
4. That sUbject property shall be developed substantially in
accordance with plans and specifications on file with the City of
Anaheim marked Exhibit No.1.
5. That Condition Nos. 1 through 4, above-mentioned, shall be
completed prior to the commencement of the activity permitted by this
conditional use permit.
6. That the use is hereby granted for a period of one (1) year
from the date herein, to expire on June 14, 1983.
BE IT FURTHER RESOLVED that the City Council of the City of
Anaheim does hereby find and determine that adoption Qf this
Resolution is expressly predicated upon applicant's compliance with
each and all of the conditions hereinabove set forth. Should any
such condition, or any part thereof, be declared invalid or unen-
forceable by the final judgment of any court of competent juris-
diction, then this Resolution, and any approvals herein contained,
shall be deemed null and void.
THE FOREGOING RESOLUTION is approved and adopted by the
