RESOLUTION NO. 71R-241
A RESOLUTION OF THE CITY COUNCIL OF THE. CITY
OF ~~AHEIM GRANTING VAR~ICE NO. 2252.
WHEREAS, after a request for variance by RONALD H.
and CHARLOTTE RHODES, OWNERS; JOSEPHINE B. LOPEZ, AGENT, was
received, a public hearing before the Planning Commission of the
City of Anaheim was held upon due and proper notice as a result
of which Variance No. 2252 was denied covering the fOllowing
described property:
Lot No. 30 of Tract No. 403, as shown on a Map recorded
in Book 16, Page 11, of Miscellaneous Maps, records
of said Orange County, California.
WHEREAS, thereafter, wi thin the time .prescribed by
law an interested party or the City Council on its. own motion
caused the .review of said Planning Commiss'ion action at a public
he.aring noticed and held as prescribed by law and as a result
thereof the City Council does hereby make the following findings:
1. That there are special circumstances applicable to
the property, inCluding size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That: be.cause of special circumstance.s. shown in
(1) above, strict application of the. zoning code
deprives the property of privileges. enjoyed by
other property under identical zoning classifica-
tion in the viCinity.
NOW, THEREFORE, BE IT RESOLVED by. the City Council of
the City .of Anaheim, that said variance be granted subject to the
fOllowing conditions:
1. Th.at subject property shall be developed subs.tantially
in accordance with plans and specifications on file
wi th the City of Anaheim marked Exhibi.t lio. 1.
2. That adequate clearance of existing electrical lines
shall be provided as required by the Electrical
Division, Department of Public Utilities, and the
State of California G.O. 95.
3. That the approximate building and electrical permits
for the existing roof sign shall be acquired within
30 days from the date of this resolution.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good cause
or failure of said owners, the.ir heirs 1 successors or assigns to
comply with the Anaheim Municipal Code and regulations and the
conditions herein. Said variance is granted for a te~ to expire
August, 1974.
THE FOREGOING RESOLUTION is approved and signed by me
this 8th day of June, 1971.
