RESOLUTION NO. 71R- 209
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM PROVIDING ASSURANCE. OF COMPLIANCE
WITH THE PROVISIONS OF THE UNIFORM REAL PRO-
PERTY ACQUISITION POLICIES ACT OF 1970.
WHEREAS, the Uniform Relocation Ass'i"stance and Real
Property Acquisition Policies Act of 1970, P.L. 91-646, herein-
after called the nAct" establishes uniform pOlicies on real pro-
perty acquisi tion practices wi.t.h respect to such programs r and
WHEREAS, the Act is applicable to various 'programs and
projects receiving financial assistance from a Federal Agency such
as the Department of Housing and Urban Development (hereinafter
called IIHUDU)i and
WHEREAS, the City Council seeks financial ass'is1:ance
pursuant t.o a project identified below, which project (he.reinafter
called the "Undertaking II) is subj.ect to the. Act. and is administered
by HUD; and
WHEREAS, the activities for which such assistance is
sought will involve land acquisition occurring on or after
January 2, 1971, the effective date of the Act: and
WHEREAS, Section 305 of the Act requires the provision
of certain assurances before the head of a Federal agency can pro-
vide financial assistance to pay all or part of the cost of any
program or project whi.ch will result in real property acquisition
as defined in the Act.
NOW, THEREFORE, BE IT RESOLVED by. the City Council of
the City of Anaheim;
A. That the United States of America and the Secretary of
Housing and Urban Development be, and they hereby are, provided
through the adoption of this resolution, with. .the followi~g assur-
ances regarding conduct by the City Council of the Undertaki~g
for whiCh Federal financial assistance is sought.
1. In acquiring real property in connection wi.th. the
foregoing identified projects,' contracts or agree-
ments, the City Council wi.lI be. .guided to the
greatest extent practicable under state law, by. the
1and acquisition po1icies set out under Section 301
of the Act and the provisions of Section 302 there-
of;
2. Property owners will be paid or reimbursed for
necessary expen.ses as specified in Sections '303 and
304 of the Act; and
3. The City Council hereby gives assurance that it has
authority under applicable State .and local law to
comply with Section 305 of the Act, notwithstand-
ing any provisions set forth in the. financial
assistance agreement(s) between tne City of Anaheim
and HUD, and in this connection hereby 'authorizes
the provision to HUD of the opinion of its legal
counsel to that affect.

B. The City Manager or Assistant City Manager of this
public body is hereby authorized and directe.d to execute .such .
amendment (s) to the applicable financial ass"istance agreement (.s.)
between this body and HUD and to execute, furnish and be bound
by such additional documentation as may be required in order to
comply with the Act as the Secretary of Housing and Urban Develop-
ment .shall dete'rmine nec.essary to effectuate or implement the
assurances. provided he.reunder.
C. This document is he.reby. made a part of and is incorporated
in the financial assistance agreement (s) b.etween the City of Anahe.im
and HUD for the Undertaking iden.tified below and shall be 'deemed
to supersed.e any provision (s.) in said agreement to.. the extent that
such provision (8) may conflict with the assurances. 'or agreement
provided hereunder.
D. This resolution of assurance and agreement is applicable
to the following project. or program identified above as being

required by the Secretary of Housing and Urban Development.
