2005-143RESOLUTION N0. 2005-143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A SPECIAL PERMIT TO MOVE SIX (6) RESIDENTIAL STRUCTURES FROM 423 AND 427 LEMON AND 207, 209, 211 AND 215 WEST SANTA ANA TO REDEVELOPMENT AGENCY-OWNED LAND LOCATED EAST OF LEMON BETWEEN WATER AND STUECKLE IN THE CITY OF ANAHEIM. WHEREAS, the Anaheim Redevelopment Agency (the "Agency") intends to relocate and restore those six {6) residential structures (collectively, the "Structures") currently located at 423 and 427 South Lemon and 207, 209, 211 and 215 Santa Ana in the City of Anaheim; and WHEREAS, the Structures are currently deteriorated and damaged with substandard mechanical equipment; and WHEREAS, in accordance with Chapter 15.32 of the Anaheim Municipal Code, the Agency has filed a written application (the "Application") with the City of Anaheim for a special permit to move the Structures from their current location to Agency-owned land (i) generally located east of Lemon between Water and Stueckle in the City of Anaheim and (ii) particularly known as Lots 1, 2, 4 and 5 of Tract No.1b500 (the "Relocation Property'); and WHEREAS, the Application was set for a public hearing on July 12, 2005 at 5:30 P. M. {the "Public Hearing") and notice of the time and place fixed for the Public Hearing was given at least ten (10) days prior to the date fixed for the Public Hearing by mail to all persons owning property within a one thousand (1,000) foot radius of the Relocation Property {as the names of such owners appeared on the last available tax assessment roll); and WHEREAS, after duly conducting the Public Hearing upon the date set therefor and after duly considering the Application for a Special Permit, together with all evidence and reports submitted in connection with the Public Hearing, the City Council does find that such permit should be granted for the following reasons: 1. upon relocation and restoration, the Structures will be comparable in value, size, quality, design and appearance to the structures located to the south of the Relocation Property; 2. upon relocation and restoration, the Structures will not be detrimental to, nor diminish the value of, property near the Relocation Property; 3. upon relocation and restoration, the Structures will conform to the provisions of Title 18 of the Anaheim Municipal Code that are applicable to the Relocation Property; and 4, the relocation and restoration of the Structures has been determined to be exempt from the provisions of the California Environmental Quality Act ("CEQA"} in accordance with Section 15301(d) of the Guidelines for CEQA and has been determined not to have a significant effect on the environment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Special Permit Granted. The Application to move the six (b) Structures to the Relocation Property as set forth above is hereby granted subject to compliance with all applicable provisions of Title 1 S and 18 of the Anaheim Municipal Code.
