RESOLUTION NO. 82R-.. .J
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE CITY MANAGER TO
MAKE CERTAIN DETERMINATIONS AND APPLICATIONS
RELATING TO LOCAL SAFETY DISABILITY RETIRE-
MENTS UNDER THE PUBLIC EMPLOYEES' RETIREMENT
LAW AND TO INITIATE REQUESTS FOR REINSTATEMENT
OF EMPLOYEES RETIRED FOR DISABILITY.
WHEREAS, the City of Anaheim is a contracting agency of
the Public Employees' Retirement System; and
WHEREAS, the Public Employees' Retirement Law, Government
Code Section 21020 et seq. requires that a contracting agency
determine whether an employee of such agency in employment in which
he is classified as a local safety member is disabled for purposes
of the Public Employees' Retirement Law and whether such disability
is "industrial" within the meaning of such law; and
WHEREAS, the Public Employees' Retirement Law, Government
Code Section 21034 confers upon the City Council, the governing
body of the contracting agency, the right to delegate any authority
or duty imposed under Government Code Section 21020, et seq. to a
subordinate officer.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the City Manager be, and he is, hereby
authorized and delegated authority to make determination6 under
Section 21034 of the Government Code, on behalf of the City of
Anaheim, of disability of local safety members and whether such
disability is industrial and to certify such determinations and
all other necessary information to the Public Employees' Retire-
ment System; and
BE IT FURTHER RESOLVED that the City ~Anager of the
City of Anaheim be, and he is, authorized to make applications
on behalf of the City of Anaheim for disability retirement of
employees in employment in which they are local safety members
and to initiate requests for reinstatement for such employees who
are retired for disabi1ity~
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 10th day of
August . 1982. ~
