RESOLUTION NO. B2R-469
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING CONDITION NO. 15 OF
RESOLUTION NO. BlR-356, NUNC PRO TUNC, APPROV-
ING A ZONE CHANGE IN RECLASSIFICATION PROCEED-
INGS NO. BO-Bl-14.
WHEREAS, the City Council of the City of Anaheim hereto-
fore conducted a duly noticed public hearing as required by the
provisions of Chapter 18.03 of Title 18 of the Anaheim Municipal
Code and pursuant thereto approved a zone change in Reclassification
Proceedings No. 80-81-14, subject to certain conditions of approval,
on July 28, 1981; and
WHEREAS, the evidence and testimony received by the City
Council at said public hearing, and specifically the final session
thereof held on JUly 28, 1981, established that 22 mobilehomes and
an unspecified number of travel trailers remained on the subject
property on said date; and
WHEREAS, the action taken by the City Council on July 2B,
19B1, approving said zone change in Reclassification Proceedings No.
80-81-14 was sUbject to the express condition, among others, that
the developer be required to provide certain specified relocation
assistance to the owners of, and only to the owners of, the 22
mobilehomes remaining on the subject property on said date; and
WHEREAS, said action by the City Council was memorialized
in Resolution No. 81R-356: and
WHEREAS, through inadvertence and clerical error,
Condition No. 15 of said Resolution No. 8lR-356 failed to fully and
correctly reflect the action taken by the City Council on July 28,
1981 with regard to said required relocation assistance as herein-
above set forth; and
WHEREAS, the City Council hereby desires to amend
Condition No. 15 of Resolution No. 81R-356, nunc pro tunc, to fUlly
and correctly memorialize the action taken by the City Council with
regard to said required relocation assistance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that Condition No. 15 of Resolution No. 81R-356 be,
and the same is hereby, amended, nunc pro tunc, to read as follows:
W15. That the following relocation assistance shall
be provided by the developer to the owners of the 22
mobilehomes remaining on the property on July 28, 1981,
and proof of compliance in a form satisfactory to the City
shall be submitted prior to issuance of any building
permits:

a. The owners of the nine (9) single-wide
mobi1ehomes represented by Michael Deitch, Esq., shall be
paid the sum of $5,000.00 each.
b. The owners of the seven (7) double-wide
mobilehomes represented by Michael Deitch, Esq., shall be
paid the sum of $7,000.00 each.
c. Ms. Hewitt (Space 13) shall be paid the
sum of $7,000.00.
d. Mrs. Villa (Space 23) shall either be
relocated to a location satisfactory to her, or her
mobilehome shall be purchased for the sum of $3,000.00
with developer assuming the balance owed on her mobilehome.
e. The remaining four (4) mobilehome owners
shall be paid the sum of $5,000.00 each.
f. Developer shall pay to M~. Deitch the
attorney's fees incurred by the tenants in an amount not
to exceed $5,000.00.w
BE IT FURTHER RESOLVED that this resolution is merely de-
claratory of the action heretofore taken by the City Council on July
28, 1981 with respect to the subject matter hereof and is not an
amendment or modification of such action.
BE IT FURTHER RESOLVED that, except as expreSSly provided
herein, Resolution No. 8lR-356 shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the City
Council of the City of Anaheim this 21st day of September, 1982.
