A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AWARDING CONTRACTS FOR THE CON- VERSION OF EXISTING STREET LIGHTS FOR HIGH PRESSURE SODIUM LUMINAIRES, IN THE CITY OF ANAHEIM, ACCOUNT NO. 01-677-6329-1217C-37300. WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulated in. the City of Anaheim, to wit: The Anah.eim Bulletin, on the" .~ 2nd .and 9th .days bf September, 1982 ,. a notice invi ting sealed proposals. for furnishI'ilgthe following: All plant, labor, services, mater~als and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necess~ry to construct and complete in a good and workmanlike manner, in strict accordance wi th the specifications, plans and drawiflgs:': therefor on file in the office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: Conversion of existing street lights for high pressure sodium luminaires, in the City of Anaheim, consisting of labor and material for the conversion of existing series 6.6 amp street light circuits to 120 volt or 240 volt multiple operation, and to remove existing series 6.6 amp incandescent and mercury vapor street light luminaires, and install new multiple 120 or 240 volt high pressure sodium (HPS) luminaires, and install conversion kits on the Post Top (Flame) Units, and replace Post Top (Coolie Hat) with new/rebuilt luminaires or install conversion kits; with alternate proP9sal for labor, equipment, and material to remove existing series luminaires and install multiple high pressure sodium luminaires, with conversion kits on Post Top (Flame) units, and replace Post Top (Coolie Hat) with new/rebuilt luminaires, or install con- version kits, in accordance with the plans and specifica- t.ions on file i~"1 tne office of the City Eng i!1eer, L4_CCOt1n~: ~o. WHEREAS, said notice inviting sealed proposals for said public. improvement did provide that .sealed proposals would be received by the City of Anaheim at the Office of the City Clerk of the City of Anaheim up to the hour of 2:00 o'clock P.M. on the 30th day of September , 19 82 , for the furnishing of.a~l.plant, labor, services, mater~ars-and equipment, all ut11~t1es and transportation, includ1ng power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, the public improvement herein- above more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate" of wages in the locality in which this type of labor is to be performed" for each craft or type "of workman or mechanic needed to execute the c~ntract, and which wage scale is o~ file in the Offices of the C~ty Clerk and City Engineer; and I . . YARTIN ELECTRIC. . . . . . . summarized as .TOTAL PRICE · .$1,130,713.03 · · · · $1 , 8 6 5 i 0 8 5 ...00 · · .$2,005,761.44 · .$2,086,092.84 follows: The bids received for labor only are summarized as follows: SIERRA PACIFIC ELE.CTRlCAL . .. .. . ..$ "8",155.00 BAXTER':""GRIFFIN~~CeSPANY . . . . $ 13 ,980 . 00 GRISSOM AND JOHNSON . . . ..$ 17,185.00 ~L~RTIN ELECTRIC. · · · . . ..$ 5l,322.9l AND WHEREAS, the City Engineer did thereupon examine and tabulate said sealed proposals and did report to the City Council the result of his examination and tabulation; and WHEREAS, the City Council finds that the sealed propo- sals submi tted by HI- SODIUM CONVERSION COl1PANY, 1509 Kraemer, Uni t 0, Anaheim, California 92806, and SIERRA PACIFIC ELECTRICAL, 2542 Avalon St., Riverside, California 92509, are the lowest responsible proposals submitted, respectively, for the furnish- ing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the speci- fications,; plans and drawings therefor on file in the Office (Page 2 of 4) . .~.~.....:.. . ..___............lIII.....r.'.....~_..............._..,.;,..... ~_ .._._................_.--......~.... of the City Clerk of the City of Anaheim, the public improvement hereinabove mentioned and described, together with the appurten- ances thereto, and as specified in the notice inviting sealed pro- posals, and that said proposals of said above-named bidders should be accepted and a contract awarded to each of said bidders in accordance therewith; and WHEREAS, the City Council finds that the above-mentioned sealed proposals are the lowest responsible proposals received and that the person, firm or corporation submitting each of said proposals is a responsible person, firm or corporation and that the proposal submitted by each of said bidders is the best suited and fitted for the public improvement to be constructed. NOH, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the sealed proposal submitted by each of the contractors for the furniShing of all plant, labor, services, materials and equipment, all utilities and transportation, includ- ing power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim and the not.ice inviting sealed proposals, the public works and improvement hereinabove more particularly mentioned and de- scribed, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the construction and complet.ion of said public improvement be, and the same is hereby, awarded to each of the said above-named bidders. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby required to execute a contract in the re- quired form with the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the plans and specifications for said public improvement hereinabove described, and in accordance with the terms, condi- t.ions and proviSions of this resolution, and which contract shall further provide that the performance of the obligations thereunder shall be contingent upon the receipt by the City of certain finan- cing therefor as expressly set forth in said con~ract, and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal to one hundred percent (100%) of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the con- st.ruction of said public improvement, together with the appurten- ances thereto or such portion thereof as is covered by said con- tract, as security for the faithful performance of said contract, and a separate surety bond in an amount equal to one hundred per- cent (100%) of the construction cost of said public improvement covered by said contract, as security for the payment of all per- sons performing labor and furnishing material for said project. UI'ftIIIW-...... ~~-~_.... ............--...____...~lU.o_~--.....~......~._ AND BE IT FURTHER RESOLVED that said sUccessful bidder or bidders be, and they are hereby, required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim, public liability, property damage, compensation, and other insurance in the amounts and for the purposes set forth and specified in the notice inviting sealed proposals, and subject to the approval of the City Attorney as to form and SUfficiency. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to make, execute and enter into, for and on behalf of the City of Anaheim, a written contract with said successful bidder or bidders for the furnishing of all plant, labor, materials, and equipment and performing all work, as hereinabove more particularly described, for the construction, installation and completion of said public improvement hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general specifications and detailed specifications and drawings, and all addenda thereto, and all modifications incor- porated therein prior to the date of the opening of bids, on file in the Office of the City Clerk of the City of Anaheim and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract documents herein specified.
