1982-522 RESOLUTION NO. 82R-522 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING ABATEMENT THEREOF THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES RESOLVE: WHEREAS, the City Council of the City of Anaheim, on the 26th day of October, 1982, held a duly noticed public hearing to ascertain whether certain premises constitute a public nuisance; and WHEREAS, upon hearing and considering all re1event evidence and testimony, said City Council found and determined that such nuisance exists and should be abated; NOW, THEREFORE, the City Council hereby determines that a public nuisance as defined in the Municipal Code of the City of Anaheim exists on the premises designated as 1754 West Catalpa Avenue, City of Anaheim, California, and more particularly des- cribed as Lot No. 90, Tract No. 2396, in the following particulars: 1. 6.44.010.050 - Inoperative vehicle (a utility trailer) parked in the public's view in the front yard. 2. 6.44.010.070.0116 (i) - Motor vehicles, (cars and recreational vehicles) parked in the front yard. That the City Council hereby orders said public nuisance to be abated within 30 days as follows: 1. Park and store the utility trailer out of the public's view. For instance, behind a fence (as high as the trailer) located no closer than 25' to the front property line (the sidewalk). 2. Construct a driveway on which the "operable" motor vehicles (recreational vehicles and cars) can be parked (paved or maintained crushed rock). The entire front yard will not be considered as a driveway if it's entirely paved. The Zoning Code requires a 25' front yard in the RS-7200 Zone. The yard consists of a landscaped setback (18.26.063.010), which is an "open space...unoccupied and unobstructed from the ground upward, except as otherwise provided herein" (18.01.260). That if said abatement is not accomp1i.shed by the expira- tion of thirty (30) days, the City Manager is hereby authorized and directed to cause said public nuisance to be abated by City forces or private contract pursuant to the Anaheim Municipal Code. .......................... ....-...-- ........--..._.. .._~........"",.~. ~'JIo:o'tI.:..a....-.:.. . ~."''''''..n.._._.'''''''''''.~."_."..'',,,. ................ ..............~I~........n-~"'"""'__ ..........~_~.................-....:a.......... That the City Clerk of the City of Anaheim be and she is hereby authorized and directed to file a copy of this Resolu- tion, with findings and recommendations attached, to be served upon the owners of said premises pursuant to the Municipal Code of the City.
