1982-579 RESOLUTION NO. 82R-579 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 2389. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from PIERRE and FRANCOISE A. APHESSETCHE, owners, and M.H. OSBORN, agent, to permit an automobile repair facility in the WML(SC)W INDUSTRIAL, LIMITED (SCENIC CORRIDOR OVERLAY) ZONE on certain real property situated in the City of Anaheim, County of Orange, State of California, legally described as: PARCEL 12 IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER l-1AP FILED IN BOOK 168, PAGES 25 TO 27 INCLUSIVE OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY; and ~_.. .~. . .:--.-.-........ .-.,.... -- .-...~-...-. .:.-...........-...-__........ ...................... --:" lIlI~r._,p.. ...___..~............. WIiEREAS, ~he City Planning Commission did hold a public hearing upon said application a~ the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code, and WHEREAS, said Commission, after due inspection, investi- 9a~ion and s~udies made by i~self and in its behalf and after due consideration of all evidence and repgrts offered at said hearinq, did adopt: its Resolution No. PC82-197, approving Conditional Use Permit No. 2~a~ J and MIEREAS, thereafter, within the time prescribed by law, an int:ere8~ed-part:y or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed pUblic hearing, and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct .uch hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and MIEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, ~hatl 1. The proposed use is properly one for which. conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of ~he area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner no~ de~rimental to the particular, area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved ~ carry the traffic in the area. 5. The qrantinq of the conditional use permit under the conditions imposed will no~ be de~rimental to the peace,. health, safety and.general welfare of the citizens of the City of Anaheim. That sidewalks shall be installed along Eishenhower Circle as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer prior to the commencement of the activity author- ized by this conditional use permit. 2. That the owners of subject property shall pay the dif- ference between the industrial and commercial traffic signal assessment fees (Ordinance No. 3896) for 6,101 square feet prior to the commencement of the activity authorized by this condi- tional use permit. 3. That all automotive repair work, auto and auto parts storage shall be conducted wholly within the eXisting building. 4. That subject property shall be developed sUbstantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 5. That Condition No.4, above-mentioned, shall be com- plied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compli- ance with each and all of the conditions hereinabove set forth. Should any such condi tions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. THE FOREGOING RESOLUTION is approved and adopted by the City Council this 30th day of November, 1982.
