RES-2009-170RESOLUTION NO. 2009 -170 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CHIEF OF POLICE OR HIS DESIGNEE TO PARTICIPATE IN THE U.S. DEPARTMENT OF JUSTICE GRANT (JAG) PROGRAM IN CONJUNCTION WITH THE COUNTY OF ORANGE ON BEHALF OF THE CITY OF ANAHEIM, AUTHORIZING THE EXECUTION OF ALL REQUIRED DOCUMENTS, AND AMENDING THE BUDGET FOR FISCAL YEAR 2009 -10 ACCORDINGLY WHEREAS, the County of Orange applied for and was awarded a grant from the U.S. Department of Justice, Bureau of Justice Assistance and has been designated as the lead agency for the grant program (the "Grant Program "); and WHEREAS, the Grant Program authorizes the County of Orange to select local agencies to participate in the Grant Program, thereby entitling the local agencies to a portion of the grant funds ( "Grant Funds "); and WHEREAS, the County of Orange has selected the City to participate in the Grant Program; and WHEREAS, the City is familiar with the terms, conditions and limitations of the Grant Program; and WHEREAS, the City is willing and able to conform to each of the terms, conditions and limitations imposed upon by participation in the Grant Program; and WHEREAS, the City desires to participate with the County of Orange in the Grant Program; and WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant Funds so awarded to the City, and to increase the annual appropriations and expenditures in the appropriate City program to reflect such award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The Anaheim Chief of Police or his designee is hereby authorized to participate in the Grant Program in conjunction with the County of Orange on behalf of the City of Anaheim, a public entity established under the laws of the State of California, and execute any required documents for the purpose of obtaining any Grant Funds awarded to the City of Anaheim for such participation in the Grant Program, including any extensions and amendments thereof. 2. The City Council of the City of Anaheim hereby agrees to, and by this resolution, does accept any such Grant Funds so awarded to the City of Anaheim without further action of the City Council being required therefor. 3. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by participation in the Grant Program, and the Anaheim Chief of Police, is hereby authorized and directed to execute any agreements, assurances, or other documents as may be necessary for the purpose of participation in the Grant Program. 4. The annual budget of the City of Anaheim for fiscal year 2009 -10 is hereby amended by increasing the appropriations and authorized expenditures in Program No. 218 - 309 -3021 in such amounts as are equal to the amount of Grant Funds to be received by the City.
