A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE SUBMITTAL TO THE
CALIFORNIA DEPARTMENT OF TRANSPORTATION AN
APPLICATION FOR FUNDING OF PROJECTS THAT
IMPROVE SAFETY AND CONVENIENCE FOR BICYCLE
COMMUTERS UNDER THE BICYCLE TRANSPORTATION
ACCOUNT AND READOPT THE BICYCLE MASTER PLAN
AS REQUIRED TO BE ELIGIBLE FOR FUNDING.
WHEREAS, funds are available through the California Department of
Transportation ( "Caltrans ") for city and county projects that improve safety and convenience for
bicycle commuters through the Bicycle Transportation Account ( "BTA ") (the "Funds "); and
WHEREAS, the City of Anaheim (the "City ") desires to submit an application for
award of the Funds under the BTA for bicycle trail projects along the Southern California Edison
Right of Way from Carbon Creek Channel to Stonybrook Drive and along Carbon Creek
Channel Service Road between the Southern California Edison Right of Way and 3033 W.
Orange Avenue in the City (the "Projects "); and
WHEREAS, to be eligible for the BTA Funds, the City must prepare and adopt a
Bicycle Transportation Plan between January 1, 2005 and December 31, 2009, which complies
with California Streets and Highways Code Section 891.2 and which is reviewed and approved
by the regional transportation planning agency; and
WHEREAS, the City has prepared, and the Caltrans Bicycle Facilities Unit, has
reviewed and approved the City's Bicycle Transportation Plan; and
WHEREAS, for fiscal year 2010 -11, Caltrans anticipates an appropriation of
$7.2 Million for projects that improve safety and convenience for bicycle commuters; and
WHEREAS, Caltrans Local Assistance Program Guidelines provide that BTA
Funds pay a maximum of ninety percent (90%) of the total costs of eligible projects and local
agencies must provide a minimum of ten percent (10%) of the total project cost from sources
other than the BTA; and
WHEREAS, the City is committed to provide the minimum ten percent (10%)
matching funds required by the Caltrans Local Assistance Program Guidelines; and
WHEREAS, the City is willing and able to conform to each of the terms,
conditions and limitations imposed upon any such Funds granted to the City; and
WHEREAS, the City desires to accept any such Funds which may be awarded to
the City.
NOW, THEREFORE, BE IT RESOLVED that:
The Anaheim Director of Public Works or her designee is hereby authorized to
submit an application for and on behalf of the City of Anaheim, a public entity
established under the laws of the State of California, and the Anaheim Director of
Public Works, or her designee is authorized to execute any actions necessary for the
purpose of obtaining the assistance provided by California Department of
Transportation ( "Caltrans "), including any extensions and amendments thereof.
2. The City Council of the City of Anaheim hereby agrees to, and by this resolution,
does accept any such Funds so awarded to the City of Anaheim without further action
of the City Council being required therefore and further agrees to provide the
minimum ten percent (10 %) matching funds required by the Caltrans Local
Assistance Program Guidelines.
3. The City of Anaheim hereby agrees to comply with each and all of the terms,
conditions and limitations imposed by Caltrans upon said Funds, and the Anaheim
Director of Public Works or her designee is hereby authorized and directed to execute
any agreements, assurances, or other documents as may be necessary in connection
with the acceptance of said Funds as may be required by Caltrans, if such Funds are
awarded to the City.
4. The City of Anaheim shall budget by increasing the appropriations and authorized
expenditures in such amount of said Funds received in FY 2010 — 2011.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 17th day of November, 2009, by the following roll -call vote:
