A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING GENERAL PLAN AMENDMENT N0.
2005-0043b, PERTAINING TO THE SAFETY ELEMENT
WHEREAS, on May 25, 2004, the City Council, by its Resolution No. 2004-95,
adopted a comprehensive update to the General Plan for the City of Anaheim; and
WHEREAS, the Anaheim City Planning Commission did receive verified petitions
for General Plan Amendment No. 2005-00436; Amendment No. 1 to the Mountain Park Specific
Plan No. 9U-4 (SPN2005-00031); and an amendment to the Zoning and Development Standards set
Earth in Chapter l 8. l 12 of the Anaheim Municipal Code, for certain real property situated in the City
cif Anaheim, County of Urange, State of California, as more particularly described in Planning
Commission Resolution No. PC2()OS-l l 5 and incorporated herein by this reference as if set forth
in full; and
WHEREAS, pursuant to Chapter 18.6$ of the Anaheim Municipal Code, provisions
cif the General Plan may be amended whenever the public necessity and convenience and the general
welfare require such amendment when adopted by a resolution of the City Council in the manner
prescribed by law; and
WHEREAS, on July 27, 2005, the Anaheim City Planning Commission did hold a
public hearing to consider a General Plan Amendment, designated as General Pian Amendment No.
2005-()0436, notice of said hearing having been duly given as required by law and in accordance with
the provisions of Chapter 18.60, to hear and consider evidence for and against said General Plan
Amendment and to investigate and make findings and recommendations in connection therewith;
and
WHEREAS, the General Plan Amendment proposes to amend the Safety Element of
the General Plan, Figure S-5, Fire Protection Areas, by changing the designation of certain portions
~f the Mountain Park Specific Plan No. 90-4 project area, shown as the darker shaded expanse on
the attached map, marked as Exhibit A and incorporated herein by this reference as if set forth in full,
from the Very High Fire Hazard Severity Zone to the Special Protection Area; and
WHEREAS, at said public hearing, the Anaheim City Planning Commission did
adopt its Resolution No. PC2005-114 containing a report of its findings, a summary of the evidence
presented at said hearing, and recommending that General Plan Amendment No. 2005-00436 be
adapted by the City Council; and
WHEREAS, upon receipt of said Resolution No. PC2005-1 l 4, summary of evidence,
report of findings and recommendations of the Anaheim City Planning Commission, the City
Council did fix the ?3rd day of August, 2(K:)5, as the time, and the City Council Chamber in the Civic
Center as the place for a public hearing on said proposed General Plan Amendment No.2005-00436
and did give notice thereof in the manner and as provided bylaw; and
WHEREAS, the City Council did duly hold and conduct such public hearing and did
give all persons interested therein an opportunity to be heard, and did receive evidence and reports
and did consider the recommendations of the City Planning Commission; and
WHEREAS, the City Council has certified Final Environmental Impact Report No.
331, adopting the Statement of Findings of Fact and Statement of Overriding Considerations and
Mitigation Monitoring Program No.137, as revised to add Mitigation Measure MM 6-9 and amend
Mitigation Measures MM 6-2 and MM 7-l, and has determined that said Final Environmental
Impact Report No. 33l fully complies with CEQA, reflects the independent judgment of the City
Council, and is adequate to serve as the environmental documentation for General Plan Amendment
No. ?{l()5-00436; Amendment No. l to the Mountain Park Specific Plan No. 90-4 (SPN2005-00031);
and an amendment to the Zoning and Development Standards set forth in Chapter 18.1 l2 of the
Anaheim Municipal Code applicable to the Mountain Park area; and
WHEREAS, the City Council does find and determine that General Plan Amendment
No.2005-00436, as described above, should he approved, and that the evidence presented shows that
all of the conditions exist as set forth in Subsection .030 of Section 18.68.050 of the Anaheim
Municipal Code; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that General Plan Amendment No. 2005-00436 pertaining to the Safety Element be, and
the same is hereby, approved.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 23rd day of August, 2005, by the following roll call vote:
