4747ORDINANCE NO. 4747 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING THE ZONING MAP REFERRED TO IN TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC82-110 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions conditions precedent to the making of zone or zones, which conditions have and requirements were made as a change or changes of said been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the Zoning Map referred to in Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by rezoning and reclassifying that certain property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: THAT PORTION OF THE EAST HALF OF THE NORTHWEST QUARTER OF SECTION 9, TOWNSHIP 4 SOUTH, RANGE.10 WEEST, S.B.B. & M., DESCRIBED AS FOLLOWS: BEGINNING IN THE SOUTHWEST CORNER OF LOT 18 IN TRACT NO. 2530, AS SHOWN ON A MAP RECORDED IN BOOK 102, PAGES 11 & 12, MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY; THENCE FOLLOWING ALONG THE SOUTHERLY AND SOUTHEASTERLY BOUNDARY OF SAID TRACT NO. 2530, THE FOLLOWING COURSES AND DISTANCES: S 89 DEGREES 45' 22" E. 211.00 FEET, N 56 DEGREES 27' 30" E, 141.00 FEET, N 27 DEGREES 30' 19" E. 126.00 FEET, S 89 DEGREES 45' 22" E. 177.00 FEET N 65 DEGREES 47' 14" E, 56.00 FEET, N 34 DEGREES 13' 19" E, 111.49 FEET, N 0 DEGREES 05' 29" E. 80.00 FEET TO THE NORTHEASTERLY CORNER OF LOT 1 IN SAID TRACT 2530, SAID NORTHEASTERLY CORNER ALSO BEING A POINT IN THE SOUTHERLY BOUNDARY LINE OF TRACT NO. 1597, AS SHOWN ON A MAP RECORDED IN BOOK 59, PAGES 1 & 2, MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA; THENCE LEAVING THE BOUNDARY LINE OF SAID TRACT NO. 2530 AND FOLLOWING ALONG A PORTION OF THE SOUTHERLY BOUNDARY OF SAID TRACT NO. 1597, S 89 DEGREES 45' 22" E, 210.38 FEET, MORE OR LESS TO AN INTERSECTION WITH THE WEST LINE OF THAT CERTAIN PARCEL OF LAND SHOWN AS PARCEL 2 ON A MAP FILED IN BOOK 128, PAGE 19, PARCEL MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA; THENCE S 0 -1- 81-82-21 DEGREES 05' 08" W. 103.09 FEET TO THE SOUTHWEST CORNER OF SAID PARCEL 2, SAID SOUTHWEST CORNER BEING A POINT IN THE NORTHERLY RIGHT OF WAY LINE OF THE ORANGE COUNTY FLOOD DISTRICT EASEMENT; THENCE FOLLOWING ALONG THE NORTHERLY RIGHT OF WAY LINE OF SAID FLOOD CONTROL DISTRICT EASEMENT S 54 DEGREES 18' 12" W. 1,145.00 FEET, MORE OR LESS, TO AN INTERSECTION WITH A LINE PARALLEL WITH AND 32 FEET EASTERLY OF THE CENTERLINE OF LOARA STREET; THENCE NORTHERLY ALONG THE LAST PARALLEL LINE 345 FEET, MORE OR LESS, TO THE POINT OF INTERSECTION WITH THE SOUTHERLY LINE OF THE AFORESAID -MENTIONED LOT 18 IN SAID TRACT NO. 2530; THENCE N 89 DEGREES 45' 22" W, 2 FEET TO THE POINT OF BEGINNING OF THE HEREIN DESCRIBED PARCEL OF LAND, into the "RM 1200" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: 1. That street lighting facilities along Loara Street shall be installed as required by the Office of the Utilities General Manager in accordance with specifications on file in the Office of Utilities General Manager; and that security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above-mentioned improvements. Said security shall be posted with the City prior to approval of building permits. The above -required improvements shall be installed prior to occupancy. 2. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 3. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 4. That subject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 7. That the owner of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896) in an amount as determined by the City Council, for each new dwelling unit prior to the issuance of a building permit. -2- 8. That completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 2361. 9. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 7; provided, however, that the minimum dwelling unit size shall be 540 square feet and the parking shall minimally consist of 50 covered and 50 open spaces. 10. That the location of any proposed security gates shall be subject to the approval of the City Traffic Engineer. 11. That Condition Nos. 2, 4, 5, 9 and 10, above-mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the Planning Department is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted.
