4751ORDINANCE NO. 4751 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING THE ZONING MAP REFERRED TO IN TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 68R-220 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the Zoning Map referred to in Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by rezoning and reclassifying that certain property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: All that portion of the Rancho San Juan Cajon de Santa Ana, being a portion of Lot 1 of Anaheim Extension, in the City of Anaheim, as said Lot 1 is shown on a map of survey made by William Hamel and acknowledged by Alfred Robinson, trustee, on file in the office of the County Recorder of Los Angeles County, California, more particularly described as follows: Beginning at a point in the North line of said lot, being on the South line of La Palma Avenue, distant thereon 741.59 feet West of the Northeast corner of said lot and running thence West along the North line of said lot, 76.25 feet; thence Southerly parallel with the Easterly line of said lot, 209.41 feet; thence North 73 degrees 54' 25" East 73.4 feet to a line which is parallel with the Easterly line of said lot through the point of beginning; thence Northerly along said last mentioned parallel line to the point of beginning. AND All that portion of Lot 1, Anaheim Extension, in the City of Anaheim, as shown on a map thereof made by William Hamel and on file in the office of the Recorder of Los Angeles County, California, more particularly described as follows: 67-68-68(6) Beginning at a point in the Northerly line of said Lot 1, said point being on the Southerly line of East La Palma Avenue (sometimes called East North Street) 60 feet in width, and said point being distant Westerly along said Southerly line 741.59 feet from the Northeasterly corner of said Lot 1, said point also being the Northeasterly corner of the land conveyed to John and Lorene Yoders by deed recorded in book 1782, page 22, Official Records of Orange County; thence Southeasterly along the Northeasterly line of said land of Yoders 188.10 feet, more or less, to the Southeasterly corner of said parcel; thence Northeasterly along the Southeasterly line of land conveyed to J.E. Walter et al, by deed recorded in book 1514, page 377, Official Records of Orange County, 71.80 feet; thence Northwesterly parallel with said Northeasterly boundary of Yoders, a distance of 167.10 feet, more or less, to the Southerly line of said La Palma Avenue, thence Westerly along said Southerly line 74.51 feet to the point of beginning. AND That portion of Lot 1, of Anaheim Extension, City of Anaheim, as shown on a map of Survey by William Hamel, a copy of which is shown in Book 3, Pages 162 to 164 inclusive of Los Angeles County Maps, in the office of the County Recorder of said County described as follows: Beginning at a point on the Northerly line of said Lot 1, being the Southerly line of La Palma, 60.00 feet wide, as shown on said map, distant thereon North 89 degrees 50' 30" West 591.59 feet from the Northeast corner of said Lot 1; thence parallel with the Easterly line of said Lot 1, South 15 degrees 22' 18" East 146.14 feet to the Northerly line of Lot 76 of Tract 1356, as shown on a map recorded in Book 46, Pages 25 to 27 inclusive of Miscellaneous Maps in the office of the County Recorder of said County thence along the boundary of said Tract 1356, South 73 degrees 55. 20" West 72.73 feet to the Easterly line of the land described in deed to Leighton W. Ross and wife, recorded in Book 2529, Page 511 Official Records thence, along said Easterly line of Ross, North 15 degrees 22' 18" West 167.25 feet to the Northerly line of said Lot 1; thence, along said Northerly line South 89 degrees 50' 30" East 75.49 feet to the point of beginning. Excepting therefrom that portion included in the land described in deed to the City of Anaheim recorded in Book 2695, Page 324 Official Records, into the "RM -1200" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: -2- 1. That sidewalks and driveways shall be installed along La Palma Avenue and East Street, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer, prior to final building and zoning inspections. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspections. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspections. 4. That all air-conditioning facilities shall be properly shielded from view and the sound buffered from adjacent residential homes, prior to final building and zoning inspections. S. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 6. That access to the individual parcels shall be provided in accordance with the "Specific Plan of Access - Exhibit A," on file with the City of Anaheim, and all development plans shall be submitted to the Development Services Department for review and approval, prior to the issuance of a building permit. 7. That six-foot masonry walls shall be constructed between subject property and the R-1 lots, said walls to be constructed as and when the land is developed. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the Planning Department is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted.
